can my debt company give another company they decide to claim back ppi for their clients, give out personal details without permision of the account holder??

In opinion they should not be able to.....what ever happened to 'The data protection act'?

i have never given my debt company permission to disclose my address, date of birth, and especially account numbers, to a ppi company they choose to work with on behalf of clients, is this legal??

The 3rd party will be working on behalf of your iva firm to investigate the possibility that an asset may exist in the form of a juicy mis-sold ppi reclaim.

As for the legality of passing on the data,I would love somebody to challenge it but we do tend to be over a barrel so to speak!

Yes exactly plasticdaft,

If we were not in this finacial situation and were solvent, companys would not be able to do this without our permission...would they?

It seems that people in an IVA are treated like 2nd rate citizens with less rights than people who are not.

I understand that we have a duty to pay as much as possible to our creditors but who are these companys to pursue false ppi claims on our behalf without our consent or knowledge?

The question really is - is what they are doing legal? or more importantly illegal?

I don't feel comfortable with someone obtaining my data without my permission. If you sign a form and agree to this as you were missold ppi then fine but how would they know you were missold ppi in the first place if they don't ask?
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

My IP has asked about us claiming PPI,i have firmly stated that i did not have any miss-sold PPI,i would not be claiming as this is fraudaleunt & they have replied stating
"That you do not believe a policy was mis-sold is irrelevant".
They have now sent me the authority to sign so they can pass on my details to a third party to investigate PPI,but in the letter it states "Although your supervisor has the authority to speak to your creditors regarding this under the provisions of your Individual Voluntary Arrangement (IVA),It will speed the process if you sign both the attached authority & complete the quetionnaire".

So,do they need your consent or not,i have emailed my ip asking to clarify this as they have sent me the form to sign for authority but then contradict it by stating the above statement.I have not had a reply.

I have also found out the statements that this third party are using to send to my creditors are totally mis-representing us

I had an authority letter last year about mis sold ppi from my
I.P. after I had already had a call from them asking me about whether I had ever had PPI.I explained to them that I had never opted for ppi on any of my loans or credit cards but they still sent me a letter of authority to sign which I threw in the bin!.
Do you think they may have proceeded to make any claims on our behalf without telling us?
If they have,how would we find out?

I had a letter about PPI but, as I never took it out, I just wrote across the paperwork - 'No PPI' (as instructed by my IP) and I've heard nothing more about it.

I got a letter from my IP a year ago asking me to sign about PPI I also felt it was wrong to try and claim and in the majority of cases I would be claiming against my creditors. I worried about it for a while then I just threw it away. It was not sent recorded delivery so I decided they could not prove I had received it.

I am sure they can give out some personal information without your consent, this happens all the time anyway which is why we end up with endless junk mail etc etc, I think if the information is already in the public domain as such (as in your name and address etc) then there's not a lot you can do to challenge it
