well i have emailed size5 about this,and i would have thought that the ergency to clear up this mess would have been formost to that company,but only one email saying they would be looking at it,no phone call or email since,oh and they want £250 plus vat out of me,they should be paying me can you believe just how stressful all this is to me,i think that nobody should have to go through that,
never cment on me speling its rubbish and i didnt go to schola lot okk

made bankrupt 1st august 2012 at 10.00am
now disharged so bankrupt no more thank god im free of debt now

Hi

I am sure that Size 5 will sort this out and get to the bottom of this. I am guessing that there are crossed wires/letters regarding your case

As others have said your first port of call is with the company concerned, write to them formally stating all the points that you are not ahppy with.

I am sure it will all be resolved

I think he said he would look at it on his return to the office Wednesday Terry, maybe there was something more pressing to deal with as we've just had the extra bank holiday. I'm sure they will deal with it in due course, but it may be you will have to be a little patient. At least they confirmed it's received and they will look into it. It is only 48 hours since we went back to work (some of us) so maybe next week it will be cleared up.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

well hopefully mondays phone call will be an end to it,although after all thats gone on,do you think its fair i should be charged the money they are after,and they will be just another creditor in my bankrupsy,i though iva companys were there to help not end up as a creditor andy

all that i have written on here is the truth and i have the paperwork to back it all up,i just want the iva company to see that all i want is my personal paperwork back i sent them ,thats mine and does not belong to them,JUST HOW MANY TIMES do i have to ask them before they listen

It could well be that Mime is still investigating or the people he needs to speak to are on leave. Loads of us in my office took the whole week off.

I think it fair they get their fee as they did the work. Equally, you could deduct reasonable costs such as phone credit.

I agree with BOL, maybe they need to get the full picture and to do that they will need to speak to who had communication with you and they could be on leave.

I really do understand your concerns but try and wait until Monday as there is really nothing that can be done until then.

It is very easy, and understandable, to work yourself up into a frenzy about this over the weekend so try to put it to one side and enjoy your weekend

You can rest assured, Terry, that Mike will be dealing with this for you behind the scenes - so please do give him the change to make amends if this is necessary.

There is no "IVA Ombudsman" and the regulators are not likely to get too interested in this type of issue, particularly if you have not given your firm the right to reply. This is one of the most reputable firms in the profession, and I can assure you that the matter will be sorted out for you as quickly as they can.

well i will be ringing the company monday and letting them know my feelings,and i will be recording the phone call,i know who i spoke to when i rang up and said i would not be going ahead with the iva,maybe they make a mistake we all make mistakes,but im just glad i did not go with that company now,its seems now that all they want is there money,regardless of how they performed as a company
if you sent your car for a repair in a garage and they messed it up,would you pay?

As Andy suggested - perhaps to need to write them a letter - identifying the problems and what you would like done about it.

I am all for ranting and raving - but when making a formal complaint, you need to stick to points you want addressed. and what exactly you want done about.

Send this by recorded delivery - then wait for them to respond within the time as stated in their complaint procedures, IF and when you are still not happy with the response then, make the complaint formal , using all the communication you been sent.

Hi Terry

Are they saying the IVA is approved by creditors but are giving you two weeks to decide if you prefer to go bankrupt which may be acknowledging your late request to say you no longer wanted to be in an IVA, However I dont really understand this because Im sure that once creditors approve the IVA at the meeting of creditors it is binding,dont forget the nominee is there acting as you,(others may know otherwise on this) obviously the £250 will be a bankruptcy debt in either event however if the IVA is approved then you cant go bankrupt anyway till the company issue a termination letter and that could be months away.
