Me and my boyfriend are expecting a baby (due in June) and with his savings, has managed to scrape together a deposit for a mortgage on a house. Me and baby will be living there too but when we first started off the process and were honest, no one would go near him becaus eof me and my IVA or were recieivng rates which are sky high. Long story short, he decided to go ahead with the mortgage in a sole name (after finding out that a joint mortgage would effect his credit score). We have now been asked by the solicitor to confirm if OH will be the only person in the property. He confirmed it as yes as adding me would cause trouble again.... I know this was just for 'break up purposes' or if the mortgage doesnt get paid, but i am getting so stressed that me and the baby wont be able to move in. I assume once keys are exchanged etc it shouldnt matter?
Odd question for the solicitor to ask ! Unless there are any restrictions on occupancy actually in the deeds it should be of no interest to him. Did your b/f use any specific mortgage scheme (maybe intended for sole occupancy), or is the property specifically for single occupancy?
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
It was a questionnaire from the solicitor... are you in agreement with the mortgage offer? do you accept T&C's etc. Then it asked, please confirm who will be living in the house after completion.
Like you guys, i am sure its just for their records. Its not specfic to the mortgage or anything so i think we will just stay quiet!
You will be fine - I understand they notify the council authorities for council tax purposes during the sale of a house and therefore when he has moved in you will need to inform them that you have also joined him so that the single person occupancy reduction can be withdrawn etc.
Equally your own I&E will need to be reviewed at this time as you will need to make sure your IVA payment is sustainable especially with paper due soon.

The greatness of a man is not in how much wealth he acquires, but in his integrity and his ability to affect those around him positively.

Routine question now on application !! - rationale behind this if the property is repossessed then any sitting tenants would have rights over getting evicted by the bank. The the posters other half has signed NO to the form - any of those rights have be signed away !!. However if the poster is making contributons to the mortgage then she needs protection over the property - this can be done at a solictors with the addition of a separate document, agreement between parties - without affecting the mortgage application.
