Sorry you are having so many problems. Not sure what you mean by GT wanting you to try and change your terms and conditions. What exactly are they asking?

Twenty changes in total on the top of the letter in big letters DEADLINE !st MARCH URGENT RESPONSE REQUIRED Well Ive even had the bank manager phone and ask where my certificate is as my credit rating at the moment is nil I cant move forward without it and every time I get a promise of a call back nothing happens Thank you for your advice will send an email Jeff

If it was like mine, then one of the biggest changes is the fee structure, but this will hardly be relevant as you have already finished, although I guess it may depend when BE actually last took a fee.

My fee structure with BE was capped at £75 + VAT per month and GT fees are 25% of the monthly payment uncapped - in my circumstances that increased the fees by over 500%, so even though there was only a few months to go I initially refused to sign as I just felt it was morally wrong.

GT were quite persistent though and eventually I agreed to it as I didn't want it to delay the completion process - I'm not sure that tactic worked very well in hindsight!!!

If I was you though, I'd just sign it so they can get on with your closure.

Did the fee structure change Vince, once your case had been transferred to GT? An are you saying that they are charging 25% in fees on the monthly contributions you are paying over?

Still no reply from GT wondering what to do next I finished all my payments a year ago surely a contract covers both parties I have forfilled my part it is so fustrating a year ago I was happy because I thought it was over and here we are a year later not being able to move on with my life

so its now 2 months since my original post and we have still not heard anything from GT despite emails and phone calls.

Its now over a year since we made our final payment and through no fault of our own we are still in limbo not knowing what we can do.

Is there some kind of complaint procedure we can follow, are they governed by the FSA?

First of all you need to follow GT's internal complaints procedure (not sure exactly what that is) but I would kick things off with an email to your IP entitled "Formal complaint".

State that you find it totally unacceptable that your IVA has not been closed over a year after you made your final payment. Demand a full and transparent explanation as to why your case has been not closed together with a definite date by which it will be. You might want to make reference to the following regulatory guidance:

SIP3 paragraph 9.1 "Where the arrangement has been fully implemented the supervisor should conclude his administration as expeditiously as possible."

IPA Ethics code for Members paragraph 36 "an Insolvency Practitioner in the role as office holder has a professional duty to report openly to those with an interest in the outcome of the insolvency. An Insolvency Practitioner should always report on his acts and dealings as fully as possible given the circumstances of the case, in a way that is transparent and understandable. An Insolvency Practitioner should bear in mind the expectations of others and what a reasonable and informed third party would consider appropriate"

It's probably worth asking him to send you a copy of their complaints procedure as well.

It seems very strange that your case has not been closed so long after making your final payment. There must be a good reason for this, but Vince is correct in that you ought to be informed why things are taking so long.

Hopefuly Karol will pick up on your post on Monday and be able to deal with this for you as a priority.
