We completed our IVA with GF last Feb and was told it would take 6 months to receive our certificate.

After 6 mths, chased and got told it would be another 6 mths, have chased again today and now being told that VAT issues will delay it further and we are now looking at the end of March.

Is there anything we can do about this?

Hi and welcome.

Unfortunately at the moment I don't think there is anything you can do other than keep speaking to GT. This is very much ongling at the moment and although some companies are closing cases, others aren't

I think it is awful that people have had to wait so long and are just being extended and extended. Is there any chance of getting extra people in on the closures side of things to move things along and clear the backlog?

Not all companies are closing cases though, some are still awaiting the outcome of the VAT claim.

Sorry, Phil, I don't understand the question, nor can I see where it came from. Your final payment isn't the end of your IVA. It remains active until you have the completion certificate.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Agree Foggy - I'm not sure what the question is either.

Hi all,

Well I emailed GT on the 19th Feb 2012 and received a swift response from them regarding closure. They told me they where closing cases now and my CoC should follow shortly. Fingers crossed shortly means shortly LOL.

Hi all,

This VAT issue is really annoying. I've been waiting 7 months now for my certificate. This is information I received on the 17th Feb. Still seems no end to this dispute. This is so unfair to all of us who have completed this long at at times difficult journey, stuck to the terms of our proposals, yet are being denied closure and the chance to move on to a new and better future because of a dispute between the taxman and IP's.

'As advised in my previous email the normal timescale involved in issuing a Certificate of Completion is approximately three to six months from the date of final payment. However, this period has been extended because of a recent decision by the First-Tier Tribunal (Tax) which allowed an appeal by Paymex Limited, that the fees charged by insolvency practitioners for establishing and supervising IVAs should not attract VAT. The Decision appears to have been accepted by HM Revenue & Customs and will have implications for all companies within the insolvency profession.

'We now await clarification as to when HM Revenue & Customs will refund VAT previously paid.

Whilst these enquiries are ongoing there will be a delay in closing your Arrangement. At present I cannot give you a timescale of how long this may be. Your IVA will simply remain open to collect and distribute any VAT refund due.'

It is annoying but unfortunately there is nothing you can do about it.

I know one or two companies have now started closing cases down but not all of them.
