Hi,
We are nearly one year into our IVA's and my wife has just been made redundant. She is finding it difficult to get another job and as we are now £600 a month worse off we enquired about a payment break but our case officer seems to be very reluctant to allow one. As for our review, we have told her that all our bills have gone up this year and her answer is that there is no flexibility regarding bills and housekeeping. We just keep getting told that its legally binding and that the IVA will fail!
We are fully aware of this but surely changes in cicumstances must be taken into consideration and losing your job is a very significant change!
I am presently fortunate enough to be able to work overtime sometimes but this is not always available and our case officer asked if I could cover my wifes payments but this overtime is intermittent and surely a payment break is for this kind of circumstance.
Is this the right move for us and how can we get it approved?
It just seems to us that once you sign up they stop being helpful when you need it most!

Hi and welcome to the forum

You do need to get a review with your IP company and, if necessary, request a payment break whilst your wife seeks another job.

There is flexibility regarding bills - we all know that they go up each year. Make sure you have proof if they need it.

We are with Payplan and it now seems that the help that was promised prior to signing up, is a little on the scarse side!!

You do need to speak to insist that Payplan sort out a new I&E. We do have an IP from there who posts on here. Either contact Nick Payne via the forum or speak to your own IP via this link:

Stand firm with this - you need to get things sorted.

I would suggest you email Nick who is the Payplan rep who gives advice on here to see if he can offer you any guidance regarding taking a payment break while your partner looks for another job. His email address is: nickp.payplan@gmail.com

Sorry - bankruptcy. If you had no assets I would suggest looking at this but if you own your own home it probably wouldn't be the best way to go.

Definitely send an email to Nick and keep pressing them. I cannot see how an IP company should refuse to help when there is a change like yours, although I know a few people have had this sort of response recently from Payplan.

Bankruptcy is probably not good if you own your own home and there is equity in it as you may well lose it.

Thats right, we cant lose our home! We have just emailed nickp and hope to get this resolved as soon as possible.
We have just been reading a few other threads regarding I&E and it now seems funny that ours was 'tweaked' by payplan to get the IVA approved but reading theirs and CCCs guidelines, our I&E seems unrealistic to sustain, kids grow and things break!!

Hi onlyspinone - welcome to the forum.

Sorry to read about your wife's job. This seems absolutely a justifiable rason to have a payment break if your wife hasn't been a given a payout. No company should ever leave a family struggling without trying to help in reviewing I&E, allowinf payment breaks or making necessary changes.

Hopefully Nick will get on the case as your situation should be dealt with differently to how you are describing - hope you get it resolved and your wife finds another job soon. Let us know how you get on.

Hi all,
About time for an update!
We got our payment break eventually and our case officer was very helpful this time. We are both included in the payment break but it still seems a bit unclear about overtime payments during a payment break. Is it a break fullstop or will I have to still pay half of my overtime? It was not made very clear, we were told to keep sending in wage slips and she would let us know if we are to pay extra.
As my wife has yet to find a job, is this taken into consideration ?
