Wrong Default Date on credit file

Hi Everyone,

Apologies in advance because I am sure this question has already been asked a million times but I can't see for looking. My IVA should drop off my credit file on 30th Jan 2012. I have checked my Experian file and it has the correct default dates etc on. My Equifax file is quite different. I have a default on their with Norrthern Rock and it is dated March 2006 which is a couple of months after my IVA started. I don't know who to dispute this with? I would imagine Northern Rock but I have no idea which department or phone number to ring as it is all for particular services like mortgages and pensions. Does annyone have any idea. Or who I write to if that's what I have to do?

Hi.

You need to write to the data controllers for any creditor who is doing this, enclose a copy of your completion letter and tell them to remove any defaults registered after the date of IVA acceptance.

Howsever, if it's only a couple of months then it might be as well to just wait until it drops off anyway.

Data Controller at Northern rock (they have a separate address) - you also need to send them a copy of your completion certificate.

Ask them to amend or remove the default to IVA date - however there is only two months in this - and you may find the default drops off automatically in march

Thanks guys I'm astounded at your quick response! Ordinarily I would just leave it till march but I'm looking to get a mortgage as soon as my file is clear so am chomping at the bit. Thanks so much for helping me.

the template the matrix has supplied are really useful with great working around their legal obligations, its in the sample letter area of the forum index

I rang Northern Rock in Gosforth this morning to check that is still where the Data Controllers are and the numpty that answered the phone didnt know! I will send the letter there anyway. Is this something that they can do straight away or does it unually take 28 days?

Vicki29 - don't send the letter to the normal address as these tend to be "lost in the post"

You need to follow the guidelines - otherwise complaints etc will bounce back

It tends to take an age to get this sort of thing changed, I had to make a formal complaint via the ICO to get one of my creditors to put the right dates on. Took 6 months of letters etc but got there in the end.

I haven't checked all of mine but from what I can tell the latest default date I have on mine is January 2007 and my IVA was accepted 8th December 2006 so for the sake of one month I will probably just let it drop off. I did ask a question the other day but never saw if anyone replied but basically on my capital one account they obviously sold the debt so they have put a black satisfied marker and closed the account in 2008 however default date still shows back in 2006 so I am assuming despite it being closed with a satisfied marker it will still come off because I really don't want it on there post IVA to be honest

Hi Plasticdaft - we have 10%. I have spoken to a couple of whole market brokers that have looked at copies of my credit files and they say that come February/March when the IVA and defaults drop off, they will be able to get me a mortgage. They said that they only approach lenders they know are only interested in the last 6 years and dont ask about IVA's only bankruptcies. So fingers crossed we may be ok. Im not counting my chickens though! Also I am quite lucky because I had a credit card and a Next Directory Account which I was allowed to keep throughout my IVA (not quite sure why they let me keep them to be honest but it worked in my favour)so these are on my credit file and therefore helping my scoring. Oh and I also had car finance which is now paid off so thats another bow to my string (or so i'm told).

Hi Vicki last year my son got a mortgage through a broker,a good deal too, with a local building society,after being messed about by a few large High Steet lenders their customer service was crap.
