I have been in an iva for nearly two years with payments up to date. I had iva amended quite early into it as my mum got sick just weeks after it was agreed. It was posting on the forum that helped. The company would not listen to me. They have been great since, until January. My mum passed away at Christmas of 09 and a year later (after going through probate as no will). I sold her house. Mum had released equity a few years back so I could move to a property suited to my daughter's disability (she was a fab mum!). After all payments were taken out from sale we had just over £22,000 to share between myself and my brother. My brother has had his money. I put in a full and final offer of £10,000 which I was told was a great offer. Since then everytime I ring I get told something different? I've continued to make my payments but we need oil (£700) and the boiler needs a service (£100 plus any parts and VAT). There is no way I can make Mays payment unless I don't get oil etc. When I put in offer I was told about eight weeks until it went before creditors. I rang about a month ago and was told IP on three week holiday but on his desk. Is this normal? When I rang this week I found out they have been taken over. No letter or call. Do I just not pay now until creditors see offer? I'm thinking of going bankrupt as our car is a motability car (my daughter is severely disabled). We have no equity and the house has been adapted on a grant to make it suitable for her disabilities. Sorry for long question but so tired of not knowing where I am. Is it always like this when you put in a full and final offer? Thank you

Hi. It sounds as if someone has dropped the ball here. You have waited a long time to not even have a date for the f&f meeting yet. I would keep on pushing this and also ask to take a payment break this month so you can pay for the oil you need. If this isn't adequately budgeted for in your expenditure they will be sympathetic to this additional expense. The price of oil is crazy now! Missing payments without permission isn't a good idea unless you absolutely can't avoid it. Keep on posting and let us know how you get on xx

It's nice to see you Deb, I was only thinking of you the other day. Hope your daughter is ok as well.

Can't remember but I'm assuming you are with BE and now with GT? I'd give them a ring after the bank holidays and insist that somebody does something.

You should have a date by now.

Hi Kallis and everyone.
Thanks for replies. It is BE (now GT which I only found out when they answered. I asked him if I had got through to BE and he said BE were now GT and that might have delayed things. Kallis, I know you are great on this forum (and for me personally, thanks). BE were terrible when I started with them. I posted on here early in IVA when mum got sick and they posted and asked me to contact them. They have been great until January. As I've already said I was told it was a great offer with little change of refusal. Then told by someone else it might be refused, after ten weeks and this "sitting on the desk" thing. BE asked me to fill out a questionaire about their professionalism in January. I wish they would ask again. I will ring on Tuesday. I know they deal with tonnes of cases and I'm just another but they know about my daughters weakness, thought they might show a little compassion. Thanks again!!

Personally, I think you have been treated quite shabbily by them. Doesn't matter how many cases they have, you are paying for a service and should get one!

Keep on at them and email the IP's at GT direct!

I may be missing something here - but isn't your inheritance a windfall in the IVA which creditors should be getting anyway? If you still have disposable income available to finish your IVA off, you may struggle to get that offer accepted.

The company told me when I thought I would only have £8000 that it was a great full and final Melanie. It's more the way I've been given different answers by different people and in the early stages when mum was ill my account manager gave me a payment break but when I asked for it in writing the IP said no. Thankfully after posting on here they did look again and a creditors agreed to a much smaller payment. I'm more concerned as to why nothing has been done for creditors to see my full and final offer and why I need to end IVA. If they want me to go on I will go bankrupt because after losing mum and the deterioration in my daughter that is the least of my problems

Deb, speak to your IP on Tuesday and insist on speaking to the IP and not an office worker. Find out exactly where you stand.

Thanks Jan, I'm going to. I was just a little upset by Melanie's comment. I have always been told that my offer was reaslly great and company could see no way creditors would say no as it was a great offer. Have to wait and see. We've emailed off forum so you know the situation. They are lucky to have you on here. Hope all is well with you.
