Hi I have just been told that I have terminal Cancer, I only have 16 months left on my IVA and it looks like i will be ok to the end of the IVA. However if I am not and cant continue to work or peg it before its paid off who will be responsible for paying it?

So very sorry to hear about your diagnosis.
The most important thing now is your health, not debt stress.
Have a chat with your IP, they should be able to call a variation meeting and ask for payments to date to be accepted as a full and final settlement.
Creditors should be sympathetic under the circumstances. This then will allow you to concentrate on the more important things in your life rather than worrying about an IVA.

Hi s79 - debts in your sole name will be paid from your estate. When there is no estate the debts are written off (they will not transfer to anyone else). Joint debts will fall to the other person/ people named on the account.

Please consider speaking to your IP about concluding the IVA with payments made to date. Continuing now is above and beyond the call of duty. You need to live life to the full and enjoy time with your family and friends, not worry about a few b****y debts.

I am so sorry to hear your bad news, but I agree with Lisa and urge you to contact your IP without hesitation. Strictly speaking, your debts form part of your estate, and if outstanding when you die can be claimed as such. If not outstanding, either by way of completed IVA or variation to end now upon contributions already made then they cannot.

I'm so sorry too to hear of your diagnosis, I hope Lisa & size5 comments help you as they have said exactly what I would of wanted to say. Get onto you IP asap n let us know how you get on.

What utterly devastating news, I am so sorry. Your IP should immediately take steps to see if creditors will allow the IVA to be varied to accept payments made to date in full and final settlement given the circumstances.

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Puts everything into perspective, health is much more important that a few debts, speak to your IP and try and get this finalised so you can enjoy the time you have left without the IVA around your neck.

Thinking of you at a difficult time. As your journey moves ensure you look at accessing all the services on offer when we reach this time. Various organisations can help you & your family. McMillan & Marie curie to name two. Hope your IP resolves the IVA for you but please concentrate on yourself & your family at this time.

Thanks guys but as someone said to me, we all have one thing in life and that is that we will all peg it at some time, its just my time has come earlier than i anticipated. Thanks for the advice I will get on to my IP monday morning.
