Hello Everyone
Everything has gone wrong. I have totally been mis sold the IVA from Express Debt Solutions. I have paid them £250 pounds up front and they wont give it back, they have told me that for an IVA to be accepted I would have to pay back £553 per month, double what they assured me it would be. They are now saying I need to do a Debt Management Plan, but it is not what I want to do. I am distraught that I have lost that money as I could have paid my creditors with it. I have Clear Debt calling me tomorrow. I hope they can sort it out. Anyone dealing with Express Debt Solutions avoid them like the plague as they have totally told me the wrong information. I am just glad the calls were recorded as I have asked them to listen back to the conversations that I had with their advisors.
HELP, I really dont know where to go from here.

Oh J, that is not good, Clear Debt are a good firm and will hopefully be able to help you. One of the more experienced posters will be along very soon to offer some solid advice, I can understand your distress at losing your money fully. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Seems very strange. If your debts are £15k and you have a surplus of £553 you would not need an IP to help as you could just repay the debts.

Demand your money back and if they refuse follow their complaints procedure. It is very odd to be that much out from an initial meeting to completing the financial statement. There has to be a mistake.

I have just been informed by clear debt that they have added my disability allowance to income, when they shouldnt as it is purely for living and not for paying debts. I am now going with Clear Debt as they have tried to explain everything to me fully. They have also adivsed me to call my creditors to ask if I can enter into a payment plan with them for what I can afford until they have sorted everything out for me. They have adivsed me to go to Citizens Advice about the £250 payment. I am going to follow the complaints procedure.

Personally Rugbygirl - i would ring around a few companies - look at the links here, and getting the information you need to make a informed choice about you debt.

Can i ask also Rugby girl -did you pay this £250 by Visa debit card? - if so call you bank to dispute tranasction.Invoking the chargeback procedure

(see extract below)
"if the goods and services you bought with your card are faulty or if they do not materialise, then you should contact the bank who has provided you with your Visa debit card within 120 days, requesting they initiate the chargeback process. It does not mean you will automatically and immediately get your money back. It will initially become a ‘dispute’ in which the claim will be fully investigated by both banks before any money is returned.

I am sure that Mike will agree with me that your DLA does need to be included as income, but there should be corresponding expenditure at least to cover the amount of the DLA to assist with the condition it is being paid for.

Such a shame that your initial enquiry did not work out for you, but you are now in safe hands.

Yes, re-reading this thread, it isn't as clear as I would like that that is indeed the case. The income is counted, but is offset against expenditure to cover the costs incurred as a result of the condition, in effect the money is set aside to be used for what purpose it was granted, and not to be used, either directly or indirectly, to help service any form of debt solution.

I hope that makes sense.
