my wife has opened a business account with barclays it is her business and i do not work there
i owe barclaycard as part of my iva can they takes monies from her account
and offset them against me or does being in a iva already mean they cannot enforce the debt as long as i keep up payments
am sure there will be an expert along soon enough, but I don't think they will. Surely your wife has her own finances as hers, your IVA is yours. So long as you're not both in IVAs they shouldn't be a problem. As for taking money from her for your debts, again, I belive thats not possible as you are in a legal contract with barclaycard to pay them back through the IVA.
Hang about and there's bound to be more responses soon
Hi
No they can't, you are not named on the account and your IVA has started so even if you were named on the account Barclays couldn't offset any of their debt from funds in the account.
Regards
thanks for your response ,i was a bit worried they could
looks like finally light at the end of the tunnel my wife has her own business so in a year or so she could pay my iva off
after all the troubles and being sick on paydays ,stress and the like at last good news
one thing a iva has taught me is spend what you have and no more ,this year we had the best christmas ever and we have no bills to pay after christmas .it was a struggle but well worth it
thanks for all the support
We are both in an IVA, Barclaycard were one of my creditors but not hubbys and we still have a full, joint account open with no problems.

good point there bobby...I just told my hubby that not only had it been a debt free christmas but as you said 'there are no after christmas bills' we're not paying it off with credit. Another good feeling there
It's a fantastic feeling to know that Christmas has been paid for in cash. I love the feeling now when the postman walks straight past the house. At the moment all he brings is junk!
