Jan, I am fine with being in default and it showing as such, the point here is that creditors are supposed to mark your file in such a way that they acknowledge the date your IVA was started by the courts. I'm not expecting my file to be clean for 6 years but they should, according to the DP Act show that they accepted the IVA and mark me as in default or similar

I've never known any of them do that. None of mine do, and to be honest I'm not bothered. I can't get any credit anyway.

I have written to the two creditors who continue to show me in default and still OWING money with details of my IVA completion certificate - the other creditors show me in default and settled. I gave the two creditors 28 days or I would complain to the Info Commissioner - all I have had back is a letter from Santander "Customer Services" saying they are sorry I have a complaint! No answer at all from the other NatWest. So I will be writing to them again - give them another week or so and tell them I will be writing to the Info Comm and also to some newspaper money columns and my MP - it takes so much effort though and you have to keep going and not let them get away with it. I know that until my IVA comes off my record I will have an impaired credit record but Experian say my credit score is now Good! very odd - but no creditor surely can keep posting that one owes them money when it was put in my IVA and that IVA is settled. I dont want to wait until 2013 as I want to remortgage next year. Good luck Dougie with your efforts.
Once you have completed then those post IVA defaults should be removed so you have a valid complaint and I'd certainly pursue a complain.

I think what is important here is the ORIGINAL default date, yes a creditor can continue to show your account in default - month after month until the completion of the IVA but it is this ORIGINAL default date which needs to be corrected.
It should be ON or BEFORE the date of your CREDITORS MEETING. That way it will drop off your credit file at the same time as your IVA. 6 YEARS from when the IVA came into affect.
If the data is incorrect at the CRA, the DATA CONTROLLER for the creditor is responsible for ensuring it is corrected. If you inform the DATA CONTROLLER that data is FACTUALLY INCORRECT the DATA CONTROLLER has a LEGAL OBLIGATION to correct it.
You can either wait until the IVA is complete, or get those dates updated now. You may have to wait a while for the Information Commissioner to make a judgement though, he is very busy I hear!

My creditors meeting was on 23rd Dec. And in a few weeks I would like to see how my creditors have marked my file. How do you access this information without paying?
Post IVA I have been refused a credit card by both Vanquis and Capital One.
Capital One sent me a letter saying I could appeal which I did enclosing a copy of my Cetificate of Completion, and an income and expenditure form and they still refused me, citing that it may be something to do with someone I'd applied for a loan for or that I had too many outstanding committments.
Well, I've never applied for a loan with anyone else, and I have no outstanding credit committments, so I am at a complete loss.
Looks like it is easier for some to rebuild their credit rating post IVA than others!
Unfortunately you will have to pay Tillergirl, but it's just a couple of pounds for each agency.

Personally, I would check what it says on your credit file and ensure it is up to date and that the IVA is shown as satisified and any defaults are marked in some way as to indicate that no further monies are due and the account is now paid.

To be honest Tillergirl, I wouldn't bother. They can continue to default you until the end of the IVA (one of mine does it every month). Only then do they have to remove anything post IVA acceptance.
