Hi All,
Any help would be appreciated. I was 30 months into my IVA and offered full and final of £7500 back at then end of April. I provided all necessary documnets very quickly (same day in fact) for my proposal to go ahead.

It took just over 3 weeks for them to have a look at it and agree it was a good enough offer to make. I then had a phone interview one week after that just for the lady to say so this is what your offering looks ok and now I will draft a variation.
She said it would be 3 weeks to the variation being ready and out to me to sign. It now been 3 weeks 3 days and I rang today and they said oh its not ready yet but maybe ready some time next week, then once you have signed it and sent it back we will convine a meeting in 28 days.
My question is I have already made 2 payments since I proposed my variation - and by the looks of their speed could be making another two more.
I pay 421 a month so will have paid them an exta £1700 nearly since I first proposed it. Surely they based my offer on what I had paid in then? What happens to the extra money and are they taking their time so they get more payments out of me.
This is really causing me alot of stress and I just want it to be done as quickly as possible.
I am with Debt Free Direct and really am questioning whether they are acting in my best interest or theirs?
Thanks

If the timescale looks ok then if some body could give me some reasurrance that would be great

Hi JLP80, I'm not sure of timescales for a F&F but we'll keep this bumped up for a professional opinion as they will know from their practice.

Declan from DFD may be able to help you too as he posts on the forum during office hours. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Whatever money you have paid across since putting in for the F&F will be on top of your offer.

You will always owe the full amount to your creditors until the IVA is completed.

As Lesley says, hopefully Declan will be on to help out.

Hi JLP80

I am 100% with you, if you remember I put my F&F forward at the same time as you and received my telephone call on the same day as yours, saying that they (DFD) where putting my case forward too! I only received my variance meeting date yesterday!!! Which is set for the 29th July - I don't believe that they have dealt with my case in an efficient and timely manner at all! But I haven't compained as I really need them to do everything they can for me and I am therefore worried that me complaining might affect my case!!

On top of this, when my initial documents came through and I read through them, they were incorrect! The figure that I am getting from family was incorrect, even though they had the letter from my partner and mum and the figure for the amount that I have paid was also incorrect! I contacted them and let them know, they said to sign it anyway and that they would make the changes and issue the amended version to my creditors - that in itself took over 2 weeks, when all that was needed was the 2 figures correcting!!!! Then just to make matters worse, I checked the details in the proposal that they have now submitted and the figures are still incorrect!!!! They have updated the "offer" figure but not the amount paid so far figure!!! Which equates to just under £700! Surely these figures should be correct up to the date that the variance report was sent to my creditors????

I too will end up making at least one payment more - on the 20th July and am keen to know what will happen to this amount.

I have put an offer of £13,000 forward plus my payments so far which equate to £2584, so total of £15,584 will be paid - they were expecting £19,380 over 60 months - does anyone have any thoughts on this amount? I have got a doctors letter saying that I am currently signed off, receiving ongoing medication and that this has been a health issue since January this year and I have been sending scanned versions of my doctors notes to them as and when I have got them. Work are going through the motions with me, but given that part of my department is moving to Ireland soon that is also adding to my on going anxiety and depression!!!

My mum moves on the 28th August so I am going to be "homeless" then as whilst I am in this IVA no one will touch me (as my parents have refused to go guarentors given that they will be on the other side of the world) and the only private landlord that has so far agreed to rent to me, with my dog, wants £550pcm and I only have £400pcm allocated to rent under my IVA........

I am really up against it now and beginning to have panic attacks - which my doctor has but down to the stress - she has even discussed with me, my mental wellbeing and has now insisted that she sees me weekly as she doesn't want me to "do any harm to myself"

I really am having a terrible time and need there to be a light at the end of my very dark tunnel soon :-(

Sorry to rant [:I]

Hi hon,
It really sounds as if your going through it, try and keep your chin up and count down the days until the 29th.
Ive got to admit I had been quite happy with DFD so far, as in the 32(now ) months I have been with them I have never asked them to do anything for me.I now know that no contact doesnt necessarily negate a good service,if I'd had problems and had to get them to act before this I think my opinion would have been lowered along time ago.
It has taken a stupid amount of time to get the stuff together and then they are charging even more fees to end my IVA early.
I too am reluctant to complain or anything as I am worried this could affect my meeting outcome. I understand that people are busy and have more than just me to look after but I think the timescale is shocking.I have had to chase and pester the whole way which hasnt helped me at all

My meeting is now set for July 12th at 10.30am and it says they will be in touch on that day. My parents have the money ready to go so hopefully I will have the yes vote i need. I too am suffering quite badly from depression and anxiety and also have sent them a letter from my doctor which they said would back up my claim.
I have paid an extra £1260.00 (3 payments of £421.00) into the pot since my offer was approved, hopefully I wont have to make any more

My thoughts are with you at this hard time and I will be keeping my fingers crossed that it works out ok for us both

Take Care
Jen xx

Hi All
Jen & Lusso - I apologise for the slow service you have received and it is a shame that you need to pester to get anywhere and for this, again I apoloigse.

If you would like, I will take up this on both your behalf’s and ensure this gets treated as a priority as I know how important it is to both you.

Lusso - I have your case details already but Jen, would you mind dropping me a line with your name and address (my contact details can be found in my profile under the experts section) so I can retrive your file. I will be sitting down with one of our IP's later and will ensure this gets highlighted.

Thanks

Hi JLP80 - I will have all fingers and toes crossed for you hun, on the 12th July! I really hope you get a positive result from your F&F!

I know how you feel re the depression, I have never felt this low and completely out of control and I guess totally scared, I really don't know what I will do if I don't get the outcome that I need, as I don't think I can deal with all this much longer and the thought of what will happen when my mum leaves, absolutely terrifies me![:(]

Let us know how it all goes...

Declan - I have sent you all the emails that I have sent chasing and trying to get the paper work corrected - I am sure the figures need to be completely up to date given that it's a legal document??

Anything you can do would be greatly appreciated, I would also like to know what will happen should I get a negative outcome from the 29th July....

Thanks
Lusso

Hi Lusso,
Yes fantastic news, it was approved - strangley enough no body bothered to ring me and let me know. If only theyd known i had been sitting looking at the phone since about 10am maybe they would have bothered themselves to give me the good news! lol
I had to ring them myself at 12noon as I was so fed up of waiting, i then got a very blaze oh yes i thinks everyones fine and has voted in favour.
I asked straight away for the info I would need to pay my money through and am happy to say I sent the cheque recorded delivery this afternoon so hopefully they should have it tomorrow and I can finally start to pull myself together and get on with things!

I didnt sleep at all last night and I have an overwhelming sense of relief that I can go to bed tonight and try and not worry about anything.
Keeping things crossed for you
xxxxxx

I sometimes wonder if the larger IP firms actually realise that their clients are very worried when it comes to variation meetings, and that they need to be told of the outcome straight away. This should not be any different to the initial meeting of creditors.
