can student loans be included?

Hi, I have seen mixed messages on whether student loans can be included in an IVA - I owe £8000 and OH £5000? both are currently deferred. Has anyone included theirs?

Hi,

I think they can still be included in an IVA, but not bankruptcy.

I would suggest that you take professional advice if you are thinking of an iva. Visit www.iva.com for a list of companies and reviews and give one or two a ring for free and impartial advice.

Jan is correct, they must be included in an IVA proposal, however your IP can ask your other creditors to agree to exclude them from the IVA if the student loan company hold a deciding vote and are likley to reject

How much do you both owe to your total creditors respectively?

Me = 40,500 - student loan = £8,000 of this
OH = 24,100 - student loan = £5,000 of this

If I were acting for you I would include those loans, as they are less than 25% in each case, so long as all of the other creditors vote in favour they will be bound by the terms of the IVAs even if they reject.

My student loan is being included however i have been advised that this is because it is dealt with by Thesis now rather than SLC.

Student loans are now to be excluded from IVAs from the 6th April, this is so that they will now mirror how they are dealt with in bankruptcy
