I started my IVA in Dec 2004 so in theory i should have finished it in Dec 2009, but my IVA provider has increased the time by another 18 months due to missing a few months and during the IVA reduced payments due to car HP at the begining that finished 3 years ago and moving from London to Devon.

Anyway i am currently working 2 jobs to pay the IVA and it looks like one may be coming to an end soon if it does i would not be able to afford the IVA for the last 18 months and i do not want to fail it after paying so much and nearly at the finish line.

If the 2nd job did end do you think i could ask my IVA provider to use that all as a full and final. I have not mentioned it to them as iwas looking for some advice ( i feel that i am still so near but so far)[:)]

It sounds reasonable and I doubt if creditors would want the IVA failed after all this time. Produce the evidence of the loss of the second job and your IP can go to creditors.

Absolutely - five years is enough for anyone, including your creditors! I seem to be closing a few of my non-performing cases in this manner at the moment - assume other IPs are doing the same?

I have finally spoken to my IVA provider and explained that i may be losing my second job and after a lot of huffing and puffing she said that once i receive my IE form ( to see what i can afford if i did lose my second job ) she said if i went for a full and final on what i have paid so far ( nearly five years ) the creditors would get around 10p in the £. Do you think this would be accepted as it seems very low to me??

Creditors have accepted less in the past and if that is the best that can be returned there is no reason to reject. The alternative is to bankrupt you or fail the IVA which will not improve their return.

I've got one going through at 2p in the £ at the moment! More about that later on next week.

I have spoken to my IP as my second job is definately ending next week and they worked it out the creditors dividend would be just under 13p in the £. Do you think this would go through as a full and final

Why not? If it your best offer and better than bankruptcy there is no reason why the offer will be rejected.

Hi, I was looking for some advice. Ive been on an IVA for 4 and a half years. I owed 15000 and have paid back 11'809 and i am still in it for 18 months. I am in the situation where i can no longer pay my contributuons but can't afford for it to be extended any longer. I have spoken to my manager and i have got another shift but still can only manage 55.00 a month and im due to pay 150.00. Can i ask for a full and final based on what i have already paid ? I really need some help. My IP is useless!

Can I ask is that 2p in the pound including the IVA charges or are charges in addition?

Including the charges.

'To rachelmarymarie - yes you can ask your IP to suggest to creditors a closure on that basis.

I have now spoken with my IP and he seemed to think I needed to ask family members to help. This is easy for him to suggest but my Dad is out of work and I have nobody else. I suppose that only leaves bankrupsy. He didn't seem to think the creditors would settle. I did get one piece of good news in that it finishes May 2011 and not 2012 as I thought.
