Hello,
My IVA started on 03/10/03 and was completed by a F & F settlement on 07/10/07. I eventually got all the creditors within the agrrement to change the default date to the IVA start date and they all marked the accounts on the credit agencies as either "Settled" or "Partial Settlement". Today, I checked my credit files and Equifax and Experian have both removed the IVA (court information from my file) and all the Defaulted accounts have been removed except for one. The outstanding account (Argos card services)now shows as a default of £2502 with an outstanding current ammount of £2502 and the entry date is 11/10/09? (8 days from now!. Also, they are showing the default date as 11/11/2003. Up to now all other entries from this creditor on all my previous credit reports have shown the default date as 03/10/03 (same as the IVA), the default amount as £4183 and the current status as "Satisfied". I have all these on record, the last being 22/09/09. This only appears on Experian. Now it seems to me that they are moving the goalposts and are going to just keep changing the default date every month so it does not reach 6 years. Can they do this? Is it an attempt to get more money from me? I thought they were bound by law when they agreed to the original IVA (they voted yes because it was a 100 % vote at the time). Can someone advise me how to proceed with this?

Hi Barry,

I would speak to Experian first of all and see if they have made a mistake somewhere along the way and ask them to amend it.

Other than that, write to whoever it is who does the Argos card and tell them to remove the default. They cannot keep doing this.

It won't be an attempt to get any money from you, they were bound and cannot ask you for any more.

hi barry congrats getting your iva completed.ive just recieved a letter yesterday from credit expert who state they are going to write to my creditors on my behalf to ask them to update my iva as complete.at the moment it shows as current.mine was completed in june 09 so i sent all credit agencies a copy of my completion certificate to update my details.the above agency have said they can,t hence the letter they are writing,on top of this i like yourself have got to try and get all the defaults removed that have been added to the present day.it seems creditors are a law to themselves adding defaults to people who are in iva,s and who have completed.this seems to be common practice and why the government/law allows this is beyond me.may i add if you read skippy,s blog there is some sample letters and excellent advice on how to get your files updated.

Hello All,
Thanks for your replys. I checked all my paperwork and I have a letter from Argos dated 03/12/07 that informs me that they aknowledged the completion of my IVA and that their records have been updated. From Jan 08 and until last month the account on my credit file showed that the default date was 03/10/03 and the account was settled with no outstanding balance. I shall be contacting them tomorrow by phone and then I suppose I will have to repeat the letters I first sent between Oct 07 and Dec 07. Experian have said that I will have to contact Argos about this. The only thing I can do via Experian is to place a Notice of correction on my file.

Hi
Argos should not move the date of the default notice, 03/10/03, and this should have fallen off your credit file by now.
Write to Argos stating that you are also writing to the Information Commissioner

I'm quite confused about the default notices. Do they continue to accrue during the IVA or is the last one on your file that last one you received before the IVA?
7 year IVA completed in December 2016 - there is light at the end of that tunnel

Cath, default notices may continue to accrue during your IVA, but once it's finished you can ask your creditors to remove any issued after the date of your creditors' meeting.

Barry, if you have a look in my blog there is a template letter you can use to send to Argos. It was originally for someone who had been bankrupt, but you can change the wording slightly to apply it to an IVA.

just got a letter today from equifax stating that they have updated my file with iva complete.at last one result[:)],skippy is right this is going to be a long job.but i am up for it.

So far I've only had one creditor put defaults on after the IVA started - hope it stays that way.
