reclaiming bank charges

After the bank taking £235 from me this month and the past few months anyway between 80 and 200 i a seriously considering requested my bank charges back, i've looked into doing it and believe i'll fall into the "hardship" category, seeing as i am in an iva and these charges are brought about my DDs regularly being declined and going overdrawn - mainly because they charge so much the month before the next month i am playing catch up.

Obviously I KNOW any money i may get back will have to go into my IVA, thats not a problem (hopefully if its a fairly decent amount i will have enough to consider a F+F??) i have no qualms about that BUT what i need to know is will my bank shut my bank account down, i have no other bank account to fall back on and am also worried that i might not find another bank that will take me with an IVA on my record. I have tried nationwide, halifax, lloyds tsb and barclays are a no as they are included in my IVA. Post office account is no good for me because they are mainly just for benefits to be paid into.

Any suggestions on this one?

Did you change your bank account before being approved for an IVA. Are they one of your creditors?

If so, then they cannot be charging you now. You should not have any DD's for loans still set up on there.

Have you tried to get an account with the Co-op? They are very IVA friendly. If you couldn't manage that, you could always try ThinkBanking or something similar which is not a normal bank account, but you're not able to go overdrawn.

With these charges, you need to get in touch with yor IP and tell them what is happening.

Try Think Banking, they will accept you but charge a monthly fee.
How can you afford to pay the £235 bank charges whilst in an IVA ? are your payments set too high for your IVA causing you to go overdrawn each month ?

Co op is a good bank. Why are you still being charged for DD's failing if you are in an IVA?? You should have been advised to open a new account that isnt one of your creditors.

You do know that you shouldnt have an overdraft on your bank account either as its a form of credit??
Discharged today the 8th feb 2012. View is much brighter now.

I had no debts with my current bank prior to starting my IVA, i just used it to have my child benefit paid into and then started using it as my main account just before getting into the IVA.

I dont have an overdraft on my account, they allow money to go through and then charge me for it!!!

I cant afford the charges, simple as that but have been having a break for the last 2 months as we moved and needed carpets - guess what, no carpets cos all the money went on charges! My mum is helping me out with carpets now but i need to get these charges sorted out.

Tried co-op, no go but will look at thinkbanking now.

I can highly recommend the Secure Trust Bank as well. Although there is a monthly fee, there are lots of benefits of this account and no credit checking to open one. You will also get a prepaid cash card as well, which is useful for budgeting purposes.

Have your IVA payments been set too high? It seems odd that you should be overdrawn every month and suffering charges if you are able to live within your limits.

I keep forgetting about Secure Trust Mel - must remember it!

they are £270 a month, which on paper i can pay but recently with the moving and everything that goes with it, it has been harder.

I will talk to my ip on friday anyway when i phone to pay this months installment and see what they suggest.

You could ask for a payment break to get yourself back on an even keel.
