failed iva

Just a quick question (probably a stupid one, but here goes), I was in an iva for 2 years,had to let it fail cos husband lost his job so now bankrupt,had a letter from iva co saying I owe them £1,500(50% 0f extra earnings) I don't have to pay it do I.

If your IVA has failed, and you are now bankrupt then personally I don't think you are liable for these charges.

Hopefully one of the professionals will be along to advise further.

Also if these charges were before Bankruptcy can they not be included (if they are owed)

Are they aware that you are now bankrupt ?

I told them I was going to go BR and they sent me a letter of no objection so presume they do, I haven't actualy told them I am.

The IVA will have terminated upon the making of the bankruptcy order - so you will not have to pay over this money to the Supervisor. If you do have this money in a bank account it would be captured under the bankruptcy in any case.

Unfortunatly Melanie, money all got used up in 3 months before BR,with losing a wage each week.
