hi finally went bankrupt this week after waiting just over a year for synergi to send me my non-complaince notice -went default in november 2007 finally got my papers in jan 2009 -is this too long to wait? went br in 23/2/09 have got a phone interview with o/r on the 10 march 2009 . i work with a take home pay of around 1200 with over time 4 weekly . my wife has been on incapitcy benefits for last year and did not return to work for other complications -she gets £75.40 per week on benefits thats all she gets total income per month £1,600 outgoings £1,420 how much roughly would the reciever take each month- my debts are around £37000? and what questions would the reciever likely to ask me?

Hi Cowboy.

I can't answer the questions about the OR interview - that's best left to Skippy or Swans Girl if they are around.

You will be expected to pay an IPO for 3years if you have over £100 per month disposable income after your priority payments have been made. It's usually between 50 and 70% of disposable income over that figure.

First of all, yes that was way too long to wait!

Was it just you who when BR? If so, the OR won't take any money for an IPA from your wife.

To get an IPA you need to have £100 or more surplus income per month. The payments are worked out on a sliding scale depending how much surplus you have. There is a table in my blog showing how much you can expect to pay.

When I had my interview the OR went through my SOA with me and asked me what the money had been spent on. She was more interested in the loans than anything else. If you can't remember what something was spent on then say so - it's better to do that and be honest.

hi thanks for your replies but yes the br includes me and the wife . my wife only gets income capatcity benefits of £75.40 per week my take home pay is around £1200 per 4 weeks with overtime totalling to £1600 approx per month outgoings £1420 leaving me a surplus of around £180 what will happen if my overtime stops for any reason and i have no surplus or income is less to what it was after the o/r makes his decison? can i pursue synergi for misselling iva? has i belive br was my first choice as at the time of taking iva out my wife only had 3 years for her retirement which means iva probbably failed anyway if her firm retired her at 60 surely they would have seen that?i am i must admit a little worried about the interview with o/r even though i have been honest all the way- cowboy

As your wife's only income is benefits she won't get an IPA.

If you get an IPA and your income changes you can ask to have your payments reduced accordingly.

Just to answer another part of your question cowboy, I doubt you would be able to pursue Synergi for misselling an IVA. It would be hard to prove, and would probably end up costing you a lot of money in court.

The other one, which I have only just spotted, about his wife's retirement, Synergi would probably have taken the view that your wife's firm could not make her retire at 60.
