jpj if you no a payment has not come out of your bank it dos not mane you can spend it and not make the payment

Empty pockets never held anyone back. Only empty heads and empty hearts can do that.

But Chez didnt know when the first payment was coming out!! she didnt spend it cause they didnt take it,she spent it cause she didnt realise her monthly payments were supposed to have begun!

The point here is not about the IP not checking on the payments - albeit I accept that this is bad practice and has led to the current difficulty - but the fact that the money which ought to have been set aside to pay creditors has been spent. As a professional, I would have to question whether an IVA is suitable for this poster.

This is of absolutely no relevance to anyone elses case but - in my case - I had a cheque in the post to my IVA company to cover the first payment the next day after my creditors meeting. I just wanted to get things moving as soon as possible.

To anyone starting out on an IVA - get that first payment in immediately after acceptance. It will get rid of the temptation to spend money that should be going to your creditors and - the sooner you start the sooner you finish!!!

Gavin....I obviously wouldn't have spent the money if I knew they were waiting for it!! I certainly have learnt from that mistake but I can't turn the clock back!

jpj...you got it right! you seem so understanding..thank you.

melaniegiles...I made a mistake at the start of this IVA-I am only human-I did all that I could to rectify the problem and show my commitment to the IVA, but, the company made alot of mistakes too! and they are supposed to be the professionals!!

Please don't take some of the comments that you have recieved personaly,Melanie is only telling it from an ip's point of view and is not having a go at you.
As A ndy said the most important thing now is to find a way forward and continue with your iva so that you will continue on the road to becoming debt free this is very important for you and your family.
Contact your ip asap and try and sort this out i personaly think its been a misunderstanding on both parts.

Everyone here is doing the best to help you, why would your IVA provider want to fail your IVA??? They are professionals and its not in their interests to fail it. Who are you with? If they have made mistakes then you need to point this out to them in writing. I get the feeling that youre stressed and scared, if you missed 3 months of payments the company may well fail the arrangement but I wouldnt think they can agree to increase payments, take these payments and extend for a whole year!!!!. It seems very odd to me, are you sure you havent missed a further payment somewhere??? Dont give up here, you will find a lot of help from those who know what debt stress is like and also from those that deal with IVA's everyday. There are good and bad IVA companies. Can you come back with more details??

I am not an expert, I am a debtor but this just does not sound right.

I'm with debt free direct (DFD).

I definately haven't missed any other payments...the reason for increasing my payments and extending the term of the IVA was so they could recover the arrears and cover the cost of the variation meeting.

I have contacted them and they have apologised for not liasing with me earlier...now they are confident that if they put the proposal forward AGAIN--my creditors will accept.

So, i am waiting for the paperwork to arrive and I have to fill in all my income and expenditure. Thing is I just done my yearly review-do you think they will use that info..letters and photocopies of payslips etc that I already sent them??

I know you are all trying to help in any way you can.. its just i am very stressed and upset with myself for getting into this mess. I apologise for being defensive. Im actually really glad I came accross this site....just wish i'd found it earlier!!!

Whatever has happened so far, and it seems like a bit of a mess, I hope you manage to get things sorted and your iva does not fail. It must be a very stressful time for you and I hope it gets sorted for you.

The beauty of this site is you get view from all sides here - people in the same boat as you and professionals. I have found it really helps and I am so glad I came accross it before i decided on an iva as I am so much more clued up about things. I think I would have agreed to anything before as just needed to get things sorted, but i am so much more informed now and want to get everything right.

Glad you are sorting things out,we all get stressed,i totaly understand where you are coming from.
As Andy said keep posting we will help in any way we can,thats the good thing about this forum other than the professionals weve all been where you are or are going through it.

Are you saying that they are going to fail the first IVA and represent a second one? Make sure that this is properly explained within the second proposal, and the reasons why this is being done are well documented by your IP. How embarrassing for them to have to do!
