just started our iva in february 2009...we still got calls from several creditors for a couple of weeks..all i did was tell them that i was in an iva, to which their company agreed, and if they continued to call me i would make a complaint under the harrassment act...i have never had a call since....and up until our iva was approved we used to get 30 plus call a day..stick in..you'll get through it

Dont know if any of you know but the creditors are calling me and when I say the IVA was approved on 2nd June they keep asking for the reference number? Now I may be being thick but what is the reference number they need ?
They already have you address and your name, just give them your IP's contact details and end the call.
Discharged today the 8th feb 2012. View is much brighter now.
Continuing to rebuild our credit worthiness.
Hi sparklywatcher when I received my approval call I asked what I should say if and when they call, the adinistrator (Claire) said that I would receive a pack that would have all the details, in the meantime (before I get that) I would probably go the route of menorca being very polite and telling where to go.
I did have one indian call center agent ask me what court the IVA was being herd at and when at some point so I just read the details from my proposal.

I really seemed to have been lucky with regards to the amount of calls some people are getting.
I would imagine the reference number required would probably be your IVA number. I had this with Barclaycard, and they kept phoning me and asking why i had not paid for 3 months and would i like to remedy the situation by paying. I went through the usual story and they said ok and put the phone down on me. It was not until they caught me on a bad day and i spoke to their manager, that i explained to her that i was in an IVA. She asked for the IVA reference number and where the case was heard. TOld her this information and since then, i have not heard from them.
I didn't have to give Mercers any details at all. I just told them I had had an IVA approved that day and that they couldn't contact me anymore. Apart from asking for money, which I told her she couldn't have, I've heard nothing else.
However, some people do have call well into their IVA's and some have even had them start up again a year or two in, so it really is swings and roundabouts as to who gets calls and who doesn't.

Yeah I have read about the calls starting up again, I'm well prepared with the harassment lines when stating I'm in an IVA.... think it will go along these lines. Yes I am Mr XXX, my IVA was approved 03/06/09 and if you continue calling then I will have no option but to contact the courts under Section 40 of The Adimistraion of Justice Act and under the Office of Fair Trading Debtor Collection Guidance.
See what they have to say about that.

One of our posters did actually contact the court and was told that they would take action if the harrassment continued.

Yes, but I hope it doesn't need to get to that, I guess I am ready and other posters should be as well, the stressful part is over once your IVA is approved so understanding how to push back to those creditors after your approval is very valuable. Some people could take a call from them demanding payment and get worried about some of the tactics they use, so I hope people will read this post and use this forum to help them through those times.

At least the posters on here know that the creditors can't do anything to them once the IVA has been approved, and when we received our phone call telling us that, the IP stressed this point.
However, people who don't read this forum or who were so relieved about being accepted, may not have listened to this. Some call centres will tell you that they don't accept IVA's and so you still have to pay!
It really is about time some sort of strict regulations came in for these places.
