hi, its about tyler morgan, the ppi company, they have complained to RBS for met ppi, and RBS say will pay me a refund, but tyler morgan tell me that RBS wount give the money back to me ( small print ) says that if I have been in a trust deed, ( now discharged ) they will keep the money I am owed, tyler morgan are waiting for a test case so to take them to court, is this right do you know
Right or not, I cannot say. But, PPI claimed / paid after an IVA / Trust Deed, is currently viewed as an asset of the arrangement and should be paid tp the IP for distribution to the creditors (even after discharge).
RBS are one of the lenders who currently use the refund to offset their own debt and there ate numerous arguements in progress.
Whether this will ever be taken to court is anybodies guess.
