Thanks to everyone who has replied to me, it makes me feel not so alone and in the dark. Melanie, I would be very grateful if you could speak to my IP his name is John Young. I myself have been waiting for a call from him for a bit and I have never spoken to him for the two years so far. Where should I get your email addy from.

I know John Young and will have a word with him to see if he is under any creditor pressure to seek higher payments from you, or whether he just feels personally that it is wrong for you to support your daughter's further education.

Thanks for info Kenty. My partner too has nothing to do with IVA but seems to be penalised. I specifically said that I did not want him involved. At the rate this is going he might just leave anyway. Will I be better off? I doubt it. It is a nightmare again!

It won't jeopardies your IVA, but it may not get him to change his mind. If at any time during the IVA you are not satisfied with the decision of your Supervisor, you can apply to Court under S262 of the Insolvency Act for directions. Why not try and have a chat to him in the first instance about your concerns if you feel uncomforable about taking it outside the firm.

Melanie, would there be a reason why I could not use any of my payrise for my daughter? I am awaiting a call from him, perhaps I should wait until I speak to him before you having a word. Is it normal not to include daughters expenses? I told before IVA that my daughter wanted to go to college and wasnt told that I couldnt send her.

In my opinion no - but you will need to find out on what basis his argument is based. So far as I am concerened, if this does not affect your ability to make your payments then I would be allowing you to support your daughter's further education.

Perhaps I could offer you a tip! The main owner of this particular firm is a gentleman very well known to me who I feel would be very sympathetic to your circumstances, so if you get nowhere with your forthcoming chat you might like to address a letter to him directly. A call to the main office in Londonderry will track him down.

I'll let you into a secret in that I used to be the IP in that company a few years ago. They are a company which hold very strong family values.

When I spoke to the first person at the beginning, dont remember name, he was fantastic sympathetic. As a teacher i found it very comfortinga and I was so happy. But I am just stunned at the amount. I always wanted to pay money back. But just dont want to penalise my daughter for my mistakes. The way it is going my partner looks set to leave. Anyway whinge over. Thanks again

Melanie, I have had no communication from John Young only a new letter from someone acting for him stating that I cannot and they will not take my daughters fees etc into consideration. My partner also pays a mortgage on his fathers house and he is nothing to do with IVA why is his income being taken in to account? I would like to take up your offer of mediating if possible as i dont know where else to turn.
