Please can you advise me of my position as I have recieved no correspondance despite several letters to the company I have my IVA through (debtmatters) I commenced my IVA in May 2006 and have adhered to the agreement throughout. I am keen to get married to my Partner and he is concerned about how the IVA will affect us. He does not own any property at the moment and we do not live together though he is keen to purchase property soon. He also has approx £12000 savings.

Please can you tell me how my IVA will affect us if we should get married as it is the only thing preventing us from doing so.

Your Partner's assets should not be affected by your IVA if he has had nothing to do with the amalgamation of your debts.

I wonder if the property were you currently live is your own or rented?

If it is your own then its treatment is undoubtedly going to be referred to in some way in your proposal.

If you are currently living in rented, presumably when you marry you will want to move in to your own place. What you are going to have to consider initially is a mortgage. You may well find it quite difficult to obtain a mortgage in joint names because of your IVA. If you cannot get a mortgage in joint names then I think it would be difficult to secure any substantial borrowings in your partner's name solely, unless he is on a substantial salary.

His savings are his savings and even if you marry, that would still be the case.

Interested in this topic, as once my divorce has gone through, I hope to remarry, and that will most likely be whilst I am in an IVA.

i am living in rented accomodation and have no plans to get a mortgage at any time as it is owning a home that got me in this mess in the first place. My partner can get a house by his self without me being on the mortgage.

I just wondered if my annual review would include his savings as mine and his home as mine if we were married.

I do not believe your partner's savings can in anyway be treated as anyone's other than his own.

I believe the only thing you may have to do is mention to your IP that you are moving in to your partner's property and will be contributing to a mortgage as opposed to paying rent.

You certainly will have to advise your IP of change of address - make sure you do that.
