Personally, I think that is their fault, you supplied the information required at the time, and if they did not claim then tough.
You have spoken to Melanie about this haven't you? Can she sort you out?
Otherwise, I would send a copy of your completion and chairmans report and see what happens.
None of this is anyone's fault other than Westcot.

I'm really not wanting to get into any kind of public dispute with Mel or anyone associated with her. I've clearly said that her bureau is not to blame in the slightest and i wouldn't hesitate to recommend them to anyone. I came on here for advice and advice only.
However, no i don't know what to do. My options appear to be :
1)Pay them what the other creditors got which is just over 24p / £1. That would mean i have to pay wescot £860. I dont have that kind of money.
2) Stick to my guns and inform them it's their fault they didn't get their cash because they failed to confirm their claim.
Option 2 sounds best obviously but how is an individual like me supposed to take on a corporation such as wescot ? If i call up and say "Sorry, im not paying you - it's your fault you didn't get any money" I can hardly see them saying "You're right, we're to blame. I'll close down your account".
Wescot were exceptionally good at threats and i suspect they probably still are. I don't have a leg to stand on when it comes to option 2.
Like i said, Mel doesn't need to defend herself or her company. This is not her fault, it's wescots. I am posting this because i need advice and a forum is the best place to get such advice.
I have to admit I think I'd have turned to the forum for some support and advice and wouldn't have seen it as criticising my IP. I hope you get it sorted as soon as Ollie, I apologise that I've no other advice but am 100% Melanie will have advised accordingly. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I'd have done the same too. I didn't read the post as being critical against Mel or her team in anyway and was surprised by some of the resulting comments.
OllieB - I mentioned your predicament to the volunteer solicitor (a Crown Prosecutor in her paid job) of a charity I do work for. I do not know what Melanie has told you to do but subject to what Melanie has said the solicitor thought you would have a very good chance of Wescot's claim being thrown out should it go to Court. Obviously the solicitor did not know all the facts only what has been posted on here. She did say many litigation solicitors give half an hour free consultation and may even take the job on pro bono. As I say, this is all subject to Melanie's advice to you.
I am going through exactly what are going through so I fully understand what you are feeling at the moment. I won’t go into all the details with you (you can read my earlier posts for that) but just to say you are in a very strong position as you hold all the information that Wescot don’t have. After all, you are just a name on a computer screen to them so don’t take it personally (easy to say I know but it’s true). I wrote to the collection agency (on the advice of DFD) giving them all the information I had, dates, amounts, copies of chairman’s report and completion certificate etc etc but also stated that if this action was taken any further (ie it went to court) that it would be vigorously defended. Elv5 is correct in saying that you should seek legal advice (as I did on this). If Wescot want to take you to court for a relatively small debt, they will need to pay court fees and send someone to court to attend the hearing and they will want to avoid this. Stick to your guns and be strong Ollie, you have done nothing wrong so don’t beat yourself up about it!!!
