HI, I have recently recieved my IVA completion statement having completed this via F&F offer after just 2 years. I have therefore been obtaining my credit files and sending off the completion certificate.

My problem is this, I have found that my largets creditor obtained 2 CCJ's for the debt held with them, each approx 16K just ten days (10/04/06) before the IVA was approved (20/04/06).

payplan handled my iva for me, i orginally went to them when issues started to affect my finances in the Sept/OCT and the proposal was agreed before christmas, however payplan didint arrange the formal creditors meeting to be held until the following april. I still dont know why payplan took so long, i suspect they were just busy. Although I had made my creditors aware that i was persuing an IVA and gave them all the details/asked payplan to keep them informed, the previosuly mentioned creditor must have thought i was stalling and issued two ccj applications.

I spoke to payplan when i recieved the court documents and they said not to worry they would resolve it by informing the court about the iva meeting. they asked me to sign the paperwork and forward it to them so they could act for me.
I never heard anything further.

So my problem now is, I have two large ccjs on my credit record that show as unsatisfed and are preventing me being accepted for rented accomodation.

Can i get these removed or even marked as satisfied? If I had known I wouldnt have trusted payplan with this.

any advice appreciated,

thanks in advance

Jon

CCJs will remain on your credit file for six years from the date they were entered, as will the IVA. So even if you have paid off the IVA your credit file remains impaired for that duration I am afraid.

Hi
As Melanie has stated it is really irrelevent that you have CCJS registered as you will have an IVA on your credit file for the same period

Hi, thanks for your replys but i think you've missed the problem.
The issue is not that the ccj's are there but that the approx 32K is still showing as not settled.
The debts to which they relate were included within the IVA which has now been completed but my credit record shows that i have a debt outstanding of 32K when clearly this is not the case.

Could you contact the ip who dealt with your IVA or the court?? It must be frustrating knowing that the IVA is complete and yet there is still outstanding debt showing on your history,
Good luck, xx
It's nice to be back......

I think you can put a notice of correction on the file to say that those CCJ's or Defaults were included in a Satisfied IVA which was completed on XX/XX/XXXX.

Just get that taken off your file once those Defaults and CCJ have been, don't leave it on the file. Its rather naughty of them registering defaults 12 months after the IVA was agreed, as they did in my case!
We're willing to wipe the slate clean, give you a fresh start. All that we're asking in return is your cooperation.
