Really need some help on this one. Have no idea . I don't even know if when I receive my failure notice and if I go for br which is my intention before the admin thing was thrown in then do I put the debt down with no proven amount on? Or leave them off? . Some things are sent to test us but this has gone on for ages. Its like a hamster wheel at the moment. :) have to keep my sense of humour.

It is possible that some creditors have not claimed or 'proved' their debt and could have been excluded from the IVA. However, this is irrelevant now the IVA is failing so all the debts owing at the time of the original should be listed on the bankruptcy forms.

Rather than waiting any longer for the certificate of termination you should go to the judge with the completed paperwork and the fee. Ask the judge to make you bankrupt and explain the delays you are suffering. It is possible that the bankruptcy could then proceed and the money situation can then be sorted out between the OR and the Supervisor.

Thanks for that. :) will go back to the court again as the first time I got turned away as I didn't have the failure notice. Thanks for explaining again. Feel a lot clearer. :)

hi all :) i have been waiting to see what happened before posting. We went to court again and had to see the judge. He asked how it all happened and after a short chat basically sent us away again as he couldnt understand why our iva failed in the first place and asked if we had tried anyone else. We contacted another company the same day and weeks later we are now in the final stages of an iva with another company appoved by OFT and DEMSA. Brilliant company came for all our paperwork within a couple of hours of talking on the phone and contacted creditors really quickly. Its an extra year or so on the end of the iva if approved , but they dont see any problems with their proposals. Meeting in two weeks, so fingers crossed...I am a Happy bunny finally . Thanks for all your help and support. :)

debt free direct . really good :) been a rocky path . never thought anyone could get steered away from br..went two times lol! at least i can report that its not scary and people are nice there. :)

They're a good company and do have a representative on here so you can ask away with any questions and he will hopefully be around to help.
