Gina, what can I say. I am surprised they didn't take it. So sorry that you have now got to go bankrupt. Good luck with that.

As to the sister site, your hubby can always try and register again under a different name. If there are still problems then let me know and I'll have a word with admin to see if they can sort it out.

hi all, payplan pushed the failure notice through so we can apply for bankruptcy now. A copy has been sent to creditors and the county court where we will file for bankruptcy. Thing is we are still waiting for the severance pay to fund the bankruptcy which may be a few weeks yet. what shall we do? borrow the 1200 needed and get in debt again to fund bankruptcy or wait and just be firm with creditors That we are filing for bankruptcy . I am thinking of borrowing and getting it over with but then again if my husband gets te severance pay before being discharged the receiver will get it all and we will have nothing to live on. Any ideas?

Hi Gina,

Where would you borrow the money from? Personally I would wait until you get the severance pay - the creditors can't do anything worse to you other than make you bankrupt themselves (which would suit you as it would cost nothing!)

You may just have to put up with the calls in the meantime.

Yes u r right. I posted this on bankruptcy forum too as I have a few other questions. Just wanted to see what people think. Sometimes its reassurance isn't it as you panic at first. Was really quick. She said it takes 3 months. Then as a gesture did it in a week!

Of course you panic! Only natural and I'm glad the forum has been of assistance to you.

It is good that they have failed it so quickly, it does normally take three months of missed payments.

Well I went only to be told they need the failure notice...my husbands has come but not mine..contacted my supervisor and there are still funds in my account as some creditors returned the funds whatever that means. So I still have an iva and it will be a month or two before funds run out! Waiting again now. How I hate waiting its the worst part for me

So sorry to hear that Gina. Get in touch with your IP and insist that they issue you with a termination letter as you wish to go bankrupt. I'm sure they will do so.

I will do. They have been told twice to no avail. They told me it had failed and they were doing the notice and that it would be done straight away. They did my husbands straight away but are messing about with mine. Wouldn't have gone to court and had the stressful build up if they had told me . Will get on to them again tomorrow. Don't see why they can't pay it all out in one go. Crazy stuff really.

Hi still no failure notice has been given to me. My husband has his and is going br on tuesday. He has his severance pay no to do so. We noticed that some debts have jumped off my iva on to his and also some joint debts are "no proven amount" on my iva and now in full on his failure notice. I found this out as a junior staff member told me over the phone that I havnt got my failure notice as there are complications as monies keep being returned from creditors as they have gone away or can't trace my debt or other reasons as debts have changed hands so many times. Also they are saying as there are no proven amounts on my iva totalling quite a bit it would reduce the amount owing so I could apply for an administration order, which sounds strange. I have a copy of my iva and the no proven amounts on it. Does anyone know what "no proven amount" means? And also what should I do? Go ahead with br once I get my notice or sit and wait? Really confusing . I have asked many times now for my failure notice to no avail. Thanks for any help everyone. :)
