My understanding is that the IP gets paid a % from the claims company's 30-40% fee - not a % from the creditors total reclaimed monies. If an IP was paid by % returned (as in your example), then surely IP's would be doing their utmost to encourage/help debtors to self-claim, as that would maximise t...

Originally posted by Broke of London One of the terms I agreed in my IVA was to co-operate with my IP to maximise returns to creditors. Therefore, my IP could fail my IVA because I refused to co-operate and help realise an asset which would benefit creditors. But couldn't this be viewed as a contra...

I was accepted for a Vanquis card immediately after my last IVA payment and several months before i recieved my completion certificate.

Used in a sensible way and ensuring the balance is paid off each month must help improve you credit rating.

Skippy I totally agree, that if PPI has been sold/missold then it is only right that a claim is made to the possible benifit of the creditors within an IVA. That has never been the issue. What is the issue is Cleardebts refusal to accept conformation from their clients that they have never taken out...

I don't think we will get an answer on the legality of Cleardebts stance, Franky. As Cleardebt have already stated, they are interpreting this PPI issue in a different way to some IVA firms, and until a client actually challenges this stance after Cleardebt fails their IVA due to non-compliance over...

But that's the thing Andrew, it has been avoidable. But Cleardebt has made it unavoidable for their clients by 'interpreting' the issue as they have. Other IVA firms haven't taken this heavy handed approach, and have accepted their clients statement that there has been no PPI taken out, so none to b...

All very interesting Andrew, but really nothing new there that we haven't been made aware of on this thread. It just reiterates Cleardebt's stance over this matter - that they are right to force clients into submitting a claim for PPI and other firms are wrong not to. I suppose it depends who your'r...

And stuck with the bully-boy attitude of some IVA firms over this issue. My sympathy to all those who are approaching the end of the IVA path, anticipating an imminent, successful completion having adhered to all the requirements of the IVA, only to be threatened with failiure due to the 'whim' of a...

How does an IP determine whether the client has or has not had PPI sold to them in the first place (whether it's been mis sold or not)?

Does the IP gain proof from the creditors that PPI has been sold to the client in the past before this process of submitting a claim begins?

That's an interesting and informative post from Size5/David Mond. However the fact remains, that some IVA providers are not pursuing PPI claims in such a robust manner. This difference of approach disproves the view that all IPs are duty bound to ensure a PPI claim is submitted and that if they don'...
