The number (and names) of your creditors should have been listed in the proposal document for your IVA under the list of your liabilities.

Tell your creditors to read the Proposal.

The problem with the DTI is that they receive figures but do not always collate them into meaningful or useful form for publication. They then have to commission research to find out what their own records say. For example, they had to commission research into the 65,000 or so IVAs started between 1...

kerri, I don't think it's a question of the Official Receiver (OR) being more lenient. They are, in fact, quite rigorous but I suspect that, because they also 'investigate' debtors circumstances quite thoroughly, the OR is probably seen by creditors as a more credible Nominee when he puts forward pr...

kerri, one of the problems is that no one seems to have any statistics on failure rates once IVAs are in place. We know that at least 10% of the IVA proposals put forward by the IVA factories fail and I think a further 10% of approved IVAs fail - but I don't think there are any official figures on f...

True - but he also said that he didn't know anything about the outcome of the meeting until about 2 hours afterwards. I may be wrong but I read this as meaning that he was not available on the phone (if not in attendance)or consulted during the actual times given for the meeting. Maybe it would help...

I came across a sie called How To Complain.com ( http://www.howtocomplain.com/ ) and thought it might be useful to anyone who doesn't know about them. They didn't have the Insolvency Practitioners Association on their list of regulatory bodies so I contacted them and they've now fixed that. Might be...

Thanks Lily.

I would still like to know if I was right or wrong about creditors meetings. ;-)

Melanie, the professional bodies can only regulate if people complain. The fact that on their visits to IPs the professional bodies may check the procedures followed in a sample of IVA cases is not sufficient to claim that there is proactive regulation. Debtors tend to be uninformed. That is why the...

Thomas Charles are owned by Accuma who also own a firm of IPs as part of the group so they should be able to give you a speedy answer on this.

Skippy, I wasn't criticising people in debt when said IVAs aren't rocket science. Believe me, I've been there and I understand the circumstances and I've spent the last three years fighting an incompetent and dishonest IP as a result. My criticisms were aimed at IPs who fail to follow the fairly str...

Perhaps someone else can confirm this but I thought that in an IVA the debtor has to either attend the meeting or - at the very least - be in contact by telephone in order to approve any modifications that might be submitted at the last minute. The IP cannot agree these on your behalf or in your abs...

allan f. One question. I'm curious to know how the Eversheds name on the chairman's report came as a surprise. Weren't you present - or in contact by telephone - for your creditor's meeting ? Surely your IP (or the chairman) went through the creditor's votes so you could agree that they were in fact...

That was a joke (sort of).

Debt are a liability if they cannot be recovered - or repaid.

sagapal, I would take legal advice on the leases included in your IVA. Try your local Citizens Advice Centre or use the CLS direct website to find a local solicitor who can give you one hour's free legal advice. I would also take advise on your current situation and the threats from your landlord. I...

It sounds as though you already have the security of a home without the liability of a mortgage. It also sounds as though you have no assets and if you're already in receipt of benefits it seems difficult to see how you could realistically propose payments to your creditors through an IVA. I think I...
