Seems to me these days if no assets go bankrupt if you own a property with equity sell it and offer a full and final, take it or leave it, you are in a better position, with secured loans following a gruelling five years does the IVA still have any future

Hi Kris

You have some options there and good opinions from some who have travelled the same path, but remember Lisa is a qualified expert, no disrespect to anyone else, bankruptcy is no more taboo than an IVA, but the IVA will allow you to pay more back and respect to you for that

Hi Celia
What a horrible situation you have found yourself in, without knowing the full facts I do wonder why a 71 year old lady with no assets on benefits is doing in an IVA. Look on the internet and get the telephone number of Stepchange and go through your situation with them for advice

Hi Skippy What wording are you referring to this has been the same since April 2004,if anyone told you they had to notify the OR during the full three years they were simply mistaken, I understand about disagreeing however what I said is easily verified,as for Vicky the client would be in very safe ...

Hi Banquo 21 Thank you for the figures, I can now feel confident that your liability to pay into an IPO or an IPA which are the same is zero, please be aware this is my opinion as a contributer on this thread, and that to date your wife is in essence paying your IVA from her surplus income. I can als...

I would like to wager you would not pay anything at all, £528 per month sounds like a minimum 50% contribution to household living costs

An Income Payments Agreement becomes an Income Payments Order, they are essentially the same, the agreement allows you and the OR to agree a figure which is fair to you both, to be honest without knowing your exact circumstances it is hard to comment however if you are only paying your wife £200 per...

Hi Banquo 21 When the IVA was born in 1986 although a great debt solution for some it was not meant for someone like you in mind, someone with no assets. With regards to the property where you live as this property is not and never was in your name the the OR has no claim upon it, it is the duty of ...

Hi Jilly What a horrible situation you have been through and continue to tread, it seems for years to come, the part I struggle with is the original 10k loan secured via charge on your property I understand why it was never in the IVA as an IVA does not deal with secured debts, but what advantage wa...

Hi nu4an As you live in a housing association with your mum and have no assets it may be worth looking at an IVA alternative such as bankruptcy, the difference being certain to be released from debt in 12 months rather than possibly released from debt in 5 years if you manage all the payments, howev...

Hi Emma You would not be able to include the car if it is your intention to keep it because it is secured finance, your creditors will want the payments to be reasonable and if the HP finishes within your term of five or six years it is normal for your payments to then increase as you would have mor...

Hi Christine

You will possibly need to fail the IVA prior to going bankrupt your local court will advise on this but after you are made bankrupt as long as you tell the OR your forwarding address you can live wherever you like
