Update - my friend made an application to Court to vary the judgement the charging order is based on. It went to a court hearing and the judge made her pay £40 per month towards the charge:-) She pays this from her housekeeping until she has a review. So all well.

Especially as in the press today I heard if you don't insure your car it can be removed and crushed, but the insurance industry is not making it easy for the likes of us frugal people who budget everymonth to make our direct debit payments. I hope my renewal is ok next month:-)

Can you clarify if it was an IVA (I am in an IVA) and was successful in claiming back the PPI, would the creditor off set it againt their balance or would they send it to me to pay to my Supervisor. I haven't got a problem paying it into my IVA just means more for my creditors in the long run!

You'd be surprised at how many people are actually up to the necks in debt but don't admit it. The difference with us IVA'ers is that we have done something about it and are not burying our heads in the sand wishing it all would go away!

So - even if the creditor was not notified, was not given the opportunity to vote or submit a claim, they are still bound........even if it causes the IVA to fail by including it and reducing the dividend? I think that will please her!
