Hi Melanie Thank you for answering my questions. Could I ask a couple more please. 1: The reason I have waited to file for BR until after I have moved is because I am worried that if I did it now, I would not be able to get anywhere to live because I am not BR and it would show up on my credit check...

Hi Ian

Thanks for the reply.

Does this apply when the bankruptcy petition is made or only when it has been accepted by the courts?

I am right in thinking that the courts can decline a petition for any reason?

Hi Jo,

If I went down this road would I still have to worry about bailiffs and all the other nasties that come with stopping paying bills? or would there be some protection from the OR or the courts?

Currently I have not defaulted on anything.

Thanks

Hi Jo Thank you for the reply. So if the OR decides to wait for the sale of the house would I still need to pay the mortgage and all the other debts which I can no longer really afford to pay? Would the OR take over my role of the house? If so what happens if he/she is met with the same resistance t...

Hi, I am considering filing for bankruptcy but I am a little concerned about my situation and whether I would qualify. I have about £46k of unsecured debt I came out of a very nasty relationship some 20 months ago. In this relationship I brought a joint house with someone, I have continued to pay ha...

Hi Beechy No way can she afford it, the mortgage is more than she earns a month. I initially wanted to sign the house over to her but 1: she couldnt afford the payments 2: the mortgage company would lend her the money as she didnt earn enough. When you say the loan do you mean the mortgage or the lo...

Hey Dave Thank you for the informative reply. I would be very interested in your views of my situation. I will keep it brief. 3 years ago I brought a house with a girl. I put £30k equity into it at the beginning but declined signing any document to state this fact and was aware that if it failed she...

What are the differences between an IVA and BR apart from the IVA being 5 years and the fact that one might not get a mortgage again once they have been declared BR. (which I dont want :) )

Thanks

[ Hi Ladyh, Thank you for your reply. I think it would be best for me to find another company. Everyone makes mistakes for sure but I would have hoped not straight away, and not multiple mistakes. I just get the feeling I will constantly be in their toes checking everything when I am hoping to get ...

Hi, Well after a very worrying start with DFD and the fact that they thought they had sent my IVA pack to the wrong address, it finally arrived today. So far I have counted 15 mistakes in the details they have typed for me to what was said on the phone. Apparently I brought my house in 1954, yet I’m...
