If you do pull out of the IVA early, then all your debts will be resurrected, and maybe the creditors will add back the interest that had been suspended while you were in the IVA, I don't know about that second point, however probably until at least a year has passed creditors will not have received...

IVAs aren't really about saving money up so that you can go on holiday, they're about repaying your debts, and for the next 5 years the creditors have decided that repaying your debts takes precedence over going on holiday. If you can manage to do some overtime, then you'll probably find in the term...

You can't appeal an IVA, but the IP can adjourn the meeting for up to 2 weeks to find out why creditors voted against the deal and come up with a compromise (similar to what cat_1 said). If that doesn't work, then yes, you can apply for another IVA straight away, but if the first deal was rejected, ...

Thanks for that, Melanie. I have read the headnote of the Court of Appeal decision in Sheirson Vlieland-Boddy, didn't read the whole thing as in BPIR it comes to 40 pages. This seems to suggest that you can only open territorial proceedings where the centre of main interests is in another EU state, ...

I have an enquirer who has lived in France for over 3 years, all his debts are UK-based and he works over there for the BBC (I'm not sure whether on the payroll or as a contractor). He wanted to make himself bankrupt but at the High Court yesterday Registrar Simmonds refused his petition on the grou...

How long have you been in the IVA ? It can be difficult to reduce the payments if you have not been in it that long as some creditors refuse to agree to variations if it is early in the IVa period. Yo uwould have to talk to your IVA provider, and they would have to call a meeting of the creditors to...

On the information that you have provided it does seem that you are suitable for an IVA. Don't be pushed into taking the first company that comes along, do some research and pick someone that you are happy with. 12 years is too long to continue a DMP for. You would only have to remortgage your house...

Melanie
I have to confess that I haven't looked recently as just of late none of my IVAs have been in the remortgage phase. Normally I get clients to find a broker themselves ,where they've had difficulty I've referred them to Tudor Mortgage and Finance
www.tudormortgage.co.uk .

Leigh If you are thinking of buying a house during the term of your IVA, forget it. As has been said, you would certainly need a deposit, the interest rate would be high, and your IP would certainly want to know where you got your deposit from as they might claim it for the IVA. You certainly wouldn...

Nauman OK good luck to you in setting up your IVA business, I think in terms of being a lead generator you probably have some very good ideas and know your subject on this, but in terms of actually running an IVA company from an overseas call centre, I am doubtful that this is a good way to proceed....

Melanie, I see, last time one of my failed IVA clients petitioned for their own bankruptcy it was successful but it was some time ago now.

No, once you are in an IVA you can move to the States, what matters is your ability to make the IVA payments rather than your location.
I suggest that you retain a UK bank account to make the payments, this will avoid incurring bank charges from foreign transfers.

Yes, selling old personal items will not count, but buying and selling with a view to making a profit would be declarable earnings, anyway, if it's just £50 per year, no IP will take that away from you.
