Does this not fall under the statute of limitations. http://www.insolvencyhelpline.co.uk/debt_factsheets/liability_for_debts_and_the_limitation_act.php Implies here that Benefit overpayments are limited to 6 years but if you are still in receipt of benefits the DWP could recover the money from those...

No, I owe £50k and now have £150k in the bank, I couldn't care less if the IP failed the IVA at that point because I am now in a position to pay cash to any and every creditor including any IP fees. I would not in this instance give my IP the money. I would demand the the IP gives me a full and fina...

Honestly - No I don't know if they actually did turn up. I don't answer my door to anyone but that has nothing to do with the debt/iva same as I also never pickup withheld phone numbers (except the postman of course)

I disagree Catallus because on that basis any inheritance regardless of amount has to be paid to the IVA. If I get an inheritance of £100k or won the lottery and got £1Million and owed £50k at the start of the IVA then no sorry that would not all go to the IVA. I can totally assure you that if my mo...

It would have to relate to the amount inherited. Let's assume you owe £50k and are paying back 50p in the pound so £25k and are 1 year in so already paid back £5k There's a number of possibilities. 1. You inherit in the £1k - £10k area. Suspect you can wave goodbye to it. 2. If you inherited £20k wo...

Well this leads onto another interesting scenario Assume I own £50k with 50p in the pound return in the iva so £25k and they all get sold to one creditor (or more it works the same) The original creditor sells it for 10p in the pound once approved so it's value is now £5k. I then go for full and fin...

My iVA was approved with the original creditors november 2007 but have received letters over the past year of my debts being sold to other companies. MAX recovery being one of them (or all not sure, will have to check). MBNA being one of my original creditor voted yes I beleive. Maybe once MBNA (or ...

Hi Nicky c Just to clarify my point, your payments will not go up but you percentage return to you creditors would if you received a payback of charges. Not quite the same thing. gimmewine I have the usual 50% windfall clause but not sure how this would be viewed by the banks if I was counterclaimin...

Hi I have considered this (being in an IVA) but I agree with gimmewine. You gain nothing from it as it is unlikely that the bank charges alone triggered an IVA to being with. I'll take my personal scenario as an example, which I think is quite typical. IVA for £50k, paying back £30k (60%) I reckon I...

I used McCambrdgeDuffy and got my IVA past first time. All i can say is when I was loosing it and screaming down the phone at them that I had court orders etc etc (ok not literally screaming but those that have been through this know what I mean) they told me very calmly at every phone call to not p...

Thanks, It just interests me (as someone in an IVA) just how serious a problem this is for the finacial instituitions and then of course the effect it may have on people trying to enter IVAs. The financial papers are full of the amounts the banks are setting aside and reductions in profits and that ...

I've asked this question on another post but didn't get an expert answer but since this fits with my question I'll ask again. Neverending, you state (quite correctly) that lendors will get a better percentage payout thorugh an IVA then bankruptcy but the question I asked was whether the lenders coul...
