I don't think your situation is black and white. I think you should speak to someone in Scotland who can advise you on your options.

If they are persisting, please make a complaint to the OFT, as they are acting against the guidelines set down by them for debt collection.

Hi

When you say you started your IVA in January, do you mean you made contact with someone who is now in the process of preparing proposals?

Are you a homeowner? If so, what assets do you have? How much is your overall unsecured debt?

I hope your daughter is on the road to recovery.

No Julie, not if the beneficial interest can be bought by a family member, friend etc.

Also if there is only 20k equity his share is half.

Let us know how you get on.

If it does happen that you cannot change the mortgage to reduce your outgoings in order for your husband to maintain the payments to his IVA, then bankruptcy could be a solution for you with you not losing the property. The beneficial interest in your husbands name could be paid to the OR by your in...

As Ian says, it may be that the charge was present at the time your IVA was finalised, but I am sure that your IP would have been aware of this.

If there was not a CCJ against you for this debt prior to your IVA, I would contact your IP and let them know and let them deal with it.

They can be taken into account, but any IP would look into the age(s) of any children. Due to an IVA being over a 5 year period normally, it would depend on the age of any children as the family credit and and other benefits relating to children could stop if the children are of the age where they a...

You will continue to qualify for Child Benefit if you have a child under 16, a young person under 19 (under 20 in some cases) who is either studying in full-time education (A level or equivalent) or an approved training programme or a 16 or 17 year old who recently left full-time further education o...

I think if this is the only company you have contacted and you can't find any information, you should ring at least one more.

How much are you being charged?

If your debts are solely in your name and your husbands are solely in his, no you do not have to do an IVA if you can service your debt with your share of the surplus income. Personally I would suggest contacting a couple of other companies as it sounds to me that they would like 2 IVA's which may n...
