Yes that's right we missed one payment whilst the IVA was being set up so we do think they are referring to that however my wife has since paid these arrears and brought the account up to date so she will continue to pay on time each month and i guess we will just have to see what happens. But I am ...

Found an interesting case study last night. (Case 117/10) http://www.financial-ombudsman.org.uk/publications/ombudsman-news/117/117-credit.html Very similar to our situation so hopefully we have some grounds for complaint if they do default my wife. Appreciate the advice about making sure things are...

Thanks for your advise. I guess I will be going down the complaints route once a default is filed so I will keep everything in writing. Just when I thought everything was under control another spanner in the works! I appreciate this is HSBC's policy but it doesn't seem fair, especially when one part...

So just had clarification from HSBC that my wife can continue to make payments to service the loan. However as its included in my IVA she will still be filed a default against this loan. Can they do that? What are the implications of this to my wifes credit score? I know my IVA will have affected it...

Thank you. It just baffles me that they have said this to my wife - especially when she is wanting to continue making the repayments and bring the account up to date. Can't see why they wouldn't allow her to do this?!

Thanks for your reply - i thought this was the case. As we seemed to get passed around different departments when we phone up for information (my wife is 33 weeks pregnant btw so could do without all this!) Do you think we would be just as well phoning up the dedicated number to make payments and se...

Hi, Just wanted to give an update on this as we have had some conflicting information from the bank as to how we move forward. Hoping someone can help. So after contacting the bank regarding this loan they have said that my wife must continue to make the full monthly repayments of the loan as normal...

Looking through the income and expenditure budget they have prepared their is spouse's credit commitments, however at the time this was put down as my wife's credit card payments and it isn't enough to cover her credit card and the loan payment. Just don't think this has been explained clearly to me...

Thanks for your advise both. I have have just spoken with my IP and he has advised to call HSBC and explain the situation and they may be willing to take a smaller payment each month from my wife. Don't feel like I should have to do this but the IVA is set up now so guess there isn't much else I can...

So what is likely to happen if my wife is chased for payments? As mentioned we don't have the spare funds for this.
Thanks

Hi all, wonder if someone could help with this question. I have entered into a single IVA but also included in the IVA is two 'joint' debts with my wife - an overdraft on our joint current account and a loan. When calculating how much to repay the IP has included my wife's income as well as mine eve...
