I would appreciate any reply from anyone with Bankruptcy knowledge. If I had old debts which had defaulted and I was no longer making payments, could I go bankrupt without involving a new partner.Old debts amount to 16k. I just wanted to confirm that it would be regarded as an asset available to the creditors. I realise that it is probably going to be difficult to sell at present and/or get anywhere near market value as it is in a developing area with lots of new builds going ahead.

Hi
Yes your husband would hve to be involved as your IVA contribution would take into account your total household income and expenditure and would be based on your leftover disposable income. That would be offered to the creditors.

Questions for Melanie You mentioned earlier in the post that a DMP is not a sensible idea if you have equity. Say the market value was around 12k-14k and the annual charges were only about £400 would you be expected to realise whatever it could be sold for or is the IP just likely to say its not worth it.

Hi Normally you should be able to include Income Tax Liabilities in an IVA if they are more than 2 years old.
