Hello Keri,

Your financial situation would need to be assessed by a professional to see what is the best option for you.

Best bet would be to speak to an Insolvency Practitioners directly and take on their advice.

It is possible to get car hire purchase whilst in an IVA, and there are several companies now who are willing to allow this as long as they receive written approval from the Insolvency Practitioner. It is going to come down to whether or not you can sustain the agreed monthly payments to the Arrange...

I think either way, if you have clearly stated that you have no PPI and you are willing to put something in writing to confirm you do not feel you were mis-sold/took any out, for me, I don't see why you are then expected to pursue it. Hopefully your case will not be held up by this process, although...

I'm sure there are cases of that Foggy, and if a client in unsure, then it would make sense for them to claim. I still do not believe, and regulators have agreed with this, that you can force a client to pursue a claim he or she does not believe exists, or perhaps more importantly, doesn't feel was ...

If a client makes it clear that they are 100% certain that no PPI were taken out on any of the accounts they hold, I'm not sure how an Insolvency Practitioner can then force that person to pursue PPI? Seems like a bizarre method to me. I certainly know that a number of Insolvency Practitioners will ...

You would certainly have to declare this to the Insolvency Practitioner. This would would need to be declared to creditors as an asset (Cash at Bank), if the creditor doesn't choose to offset this against their debt

I would imagine repaying creditors the money that you borrowed from them would surely give you some sort of reward on a personal level? Whether creditors have behaved correctly or not is difficult to know in each individual case, but regardless they have agreed to write off money that has been lent ...

The guidelines they are most probably referring to are the CCCS guidelines, which are amended and released on an annual basis, in October. If you have been in your IVA for a four and half years, then it would seem strange that they haven't even queried at Annual Reviews as to whether any of your bas...

There are safeguards within the proposal that make sure that any re-mortgage or secured loan is not unaffordable, which would ultimately put you back in a position of financial distress.

I'm sure these will be explained by Melanie's team.

Certainly agree with the first paragraph there.

It's all very well Insolvency Practitioners not feeling comfortable with a certain clause within the protocol regarding the secured loan, and I respect that , however it is not the Insolvency Practitioners who vote on the proposal.

I think the very quick answer to this would be to contact your Insolvency Practitioner, whoever that may be. They are the only ones who can help resolve your situation.

I would expect that major voting houses, such as the Insolvency Exchange, would put this clause forward as a modification if that was the case, if a proposal is drafted as non protocol, unless there were mitigating circumstances of course.

One thing you will have to take into consideration Neil, is that if you are a property owner, a standard protocol complaint proposal will contain a clause that states you must look to remortgage the property, or obtain a secured loan, in the final year of the Arrangement. This isn't just something t...
