I totally agree with Foggy , its really not that complicated ,the contract states Remortgage and failure will result in 12 month Extension , clear as day , whats the argument? His IVA company are undoubtedly trying it on and Im 99% sure they will be better off if he took the loan rather then the 12 ...

If your IVA company did not do an annual review Consisting of I&E changes , Salary (p60 and Payslips) then they are Cowboys and should not be trading as an IVA Company .If they did and you hid the Salary increase then Im afraid you should of known better .

Andy.tw I have exactly the same clause in my IVA. There is no way to interpret it to mean anything other then how it reads! There is absolutely no mention of Secured loan in the text it specifically states Remortgage NOT Secured loan or any other method to raise funds. Its crystal clear and in black...
