Well I will let you know how it turns out. If my Trustee had asked or requested to claim it on my behalf then I would have said yes but they never.

Good news for those who may be in my situ. I ave had a call from Gladstone to state that the bank are not legaly allowed to offset the debt so it is to be paid to me. My Trustdeed company have stated that by law the debt is written off at the end of the trustdeed, so can not be offset. They are now ...

I really didnt want to kick off an argument with this post. I was worried that even tho I have been released from my TD, which should mean that my debt has been wiped out, the bank still holds this debt open otherwise they wouldnt be able to offset it. I agree with Foggy also if you are claiming whilst in an IVA but not if you have been released Melenie. Yeah but Gladstone are paid 25% of my payout which would be £25 not £2500. Plus they must be aware that banks keep the debt open for the claimant and will offset against the claim. I am surely not the first person to have done this after being in a Trust Deed. I just think it is a joke, plus I havnt...

I will do hunni. I only got the letter yesterday so have to wait to speak to Gladstone tomorrow. Just thought I would see if anyone else had had ther same issue. This is a fab site and will keep you posted on how I get on as hey its always good to pass on info if you have it. Thanks Kazza. Sam xxx

Thanks Kazza, I think so to. I just hope that Gladstone Brookes dont expect me to pay £2500 worth of fees if the bank are allowed to do this. My payout would only be about £100. If I have to pay those fees I will be back in debt again, something I have been able to avoid since starting the Trust Dee...
