As Niobe has said, have a word with a couple more firms. You do not have to use the same IP if you're not happy with everything.

You may well find there is not much difference but it's worth finding someone you can work with.

As he is self employed your partner really does need to speak to an expert. Have a look at www.iva.com and speak to a couple or three and take it from there.

Hope you get things sorted.

Not impossible but unlikely at best. If your mortgage plus your secured loan wipes out your equity then you may not have to extend. It all depends on the wording of your proposal. Have a read and get back to us.

The record is removed from your credit file six years after the first default date recorded on the account.

They should mark your file as partially settled with the first default date on or before the date of acceptance of your IVA. The defaulted account will show for six years from the date of the first default recorded, it really won't make much difference to you if they keep defaulting it due to the fa...

HSBC are well known for monitoring various gazettes and registers, including the insolvency register. as soon as your IVA shows up they will probably close the account. I would make provision now to enable a smooth transition ready for your IVA. I'm not sure about the Childrens accounts, hopefully a...

I would arrange to speak with your IP in person and go through everything with them. It may well be better for you to choose bankruptcy but the only ones qualified to give you that advice is a professional. Bankruptcy is a whole lot harder now than it used to be and you really do need some professio...

Very true Foggy, considered replies are much easier when we know what the proposal says. Perhaps the OP can give us a clue as to what the equity and proposal situation actually is. I'm more than happy to assist, I went through the equity/no equity debate toward the end of my IVA(Very much non protoc...

The reply was not protocol dependant, the pure protocol IVA seems a bit of an elusive beast! either way you should never have to address equity you simply don't have. Minimum dividend seems to have been taken care of so if there is equity then the only way to address it is to extend and if there's n...

Do you have any equity in your property? You will only need to attempt a remortgage(unlikely to actually happen) if you actually have equity to address. If you have equity then you will probably need to extend for 12 months. If you have none then you should not have to extend the IVA and it should c...
