thanks kallis3 helpfull as usual. yeh that would be the 1st step in stopping the mortgage payment. but what happens if the court for what ever reason don't accept the application? or is there not such a thing. i also take it there is no such thing as joint b.r would that have to be seperate?

as we are considering bankruptcy we have secured loan on our house & is in negative equity. would the secured loan also be included in the bankruptcy & be written off?? any advice would be GREAT.
