Mel - thanks for this. Is it not true that if there is no sufficient equity to repay the charging order after the mortgage is cleared that they could stop the sale going through ? This is my whole concern. Thanks for responding

Hi - Yes I do have one charging order but it is likely I would have sufficient equity to repay that 1 plus mortgage but certainly not an additional one.

ps. As far as I understand I would not be able to sell my home if a charging order exists unless I can repay this - thus this is where my concern comes from on the charging order effectively stopping me being able to move on with my family as it is unlikely there will be enough equity in my house to...

Hi - I need some advice please. I attended a charging order hearing 6 weeks ago which was adjourned until today. The reason being that I was in the middle of changing roles in my job and my new job had the option of earning bonuses. The judge said if I could propose an increased offer to my creditor...

Thanks Rich, I have been in the DMP now for 2 years on a very large debt of £80k (Gulp I know) I had considered an IVA however I was advised by my IFA that because I work for a bank my position could be compromised in an IVA and as such this was too much of a risk to take. Cant loose my job or I am ...

I am thinking of doing an IVA as my DMP will take 20 years to clear and this shows no light at the end of the tunnel. The questions I have is this. I am trying to get a little business up and running, and I dont kno how this would be effected in an IVA. I would not be taking any money from the busin...

I have been in a DMP with the CCCS now for 18 months, which is going ok. However my level of debt is so high the DMP is impractical as would take 24 years to pay off my debts which is silly. I am now seriously thinking of an IVA but have some concerns/questions. 1)My Mortgage is a Together Mortgage ...

Thanks Carrie, to be honest my line manager is a great guy and I would certinaly have no worries about speaking to him about this. To be honest my worry/hesitation is more based around my own embarrasment at being in this position when I am supposed to be a proffesional. I also worry as to the HR re...

Thanks Carrie - you have stated if you have gone into an IVA yourself of whether this is a DMP ? as I think that is probably quite an influential aspect of the HR decision. I very much appreciate your comments here though, as given as you say that we work for the same group it is valuable to know of...

The only term in my contract that I have identified as anywhere near vague, is that of " You must not act in a manner which may be contrary to our business interested " This is vague to say the least, and therefore I would not feel like I was lying if I entered into an IVA and chose to keep this to ...
