Hi Everyone, Really could do with some advice here. I rent and have been in the same property for nearly 9 years via a letting agency. I've now been issued an eviction notice via the courts and have to be out of the property on Aug 12th due to landlord not paying his mortgage. I'm 6 months in on IVA. I asked the letting agent what could they do for me, they say they will help as much as they can but I will also have to go through a new credit check to ensure not bankrupt or ccj's,as my circumstances could have changed over that period. There was no mention of IVA so does that mean that won't come up when they do the check. Would I be able to take a 3 month payment break as I may need this money towards somewhere new to rent. Any advice would be appreciated

Hi Paddington. A break is a possibility which you will need to discuss with your own IP. Any missed payments will be added on at the end, or need to be caught up over an agreed period.

Renting in an IVA is possible. You will fail the credit check, but some agents have been known to overlook this. Hopefully they will explain to the landlord who will still accept you (many landlords have been in IVA's too!)

I am sure that your agent will accept your past record with them as a suitable reference.

In the meantime, approach your local authority for advice.

wish I could give good news, but having just having to rent, the iva will show on the c/c and the only way rould it was by paying 6 months rent up front
This was with my iva over but sill showing.
IVA now over with and it was worth it.
now starting my life again,

Your agency should be able to provide a reference to any new landlord or you can try and rent privately. Keep your IP informed and hopefully they will be able to help you with any payment breaks or reductions.

I've moved rented properties twice since I've been in an IVA, and trust me the best thing to do is just be upfront and explain your circumstances - it will only show up on the credit check anyway, so you may as well front it up. I met with my current landlord personally when I viewed the house, and explained about it to her there and then. She did ask for some time to think it over, as it was her first time renting her property out, but eventually she decided to give us a chance, and now says shes worried about us deciding to eventually buy somewhere as she doesnt want to lose us as tentants! Be upfront, explain the position, get a reference from your agency, and I am sure you will be fine. Best of luck.

Thanks guys, some useful advise, its just so upsetting as I've lived in this house for the past nine years and I treat this as if it was my own even though I'm renting. One thing I've always made sure of that my rent and bills are paid, and that has been the case wherever I've lived. I am scared as I don't have much rainy day money. My family don't know I'm in an IVA and I don't want them to know either, my main concern is how much money they want upfront. I rang one letting agent explained my situation and they said they would need a guarantor and 6 months money up front. I just don't have that sort of money. I'm trying to see what my current agent can do as I've been with them for so long which I will chase again tomorrow and again it's whether they have a property available before my eviction date, I don't want to take anything. Sorry for this lengthy piece, just really worried right now. Will keep you posted and again still grateful for any guidance of this issue

That's a real shame to lose your home due to the financial difficulties of the landlord. Have you thought about talking to the selling agent to see if they would allow the property to be sold with you in situ - after all a paying tenant, with a good track record, is a dream to an incoming landlord.
