I have just split with my partner and have been advised by solicitor letter that I have 2 weeks to move out as he owns the flat(he is wanting to move his new girlfriend in-we had been together for 15 years)I have been in an IVA for 2.5 years and am really struggling to find somewhere to rent. I am upto date with my payments and now earn a good salary but I am afraid that I am going to be homeless soon and then lose my job. I have a cat so I dont want to share with anyone. I dont have a guarantor or 6 months rent to pay up front but I know I can easily afford the rental payments. I dont know what to do next I just feel so scared and desperate.

Hi and welcome to the forum, Can you try your local paper as a lot of private landlords accept pets, don't credit check and only want the usual deposit of a months rent and a month up front (think it is).
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Am looking through papers but not finding anything. I have tried gumtree as well but always seem to be too late. It has been such a mess in relation to relationship ending but to be issued with a solicitor letter threatening court eviction if I dont move out in 2 weeks is all a bit much for me.

I know you're on a short timescale but wondered if you could put an advert up, local shop/paper as you never know a potential landlord might see it, I do realise the paper ad could be expensive though x

Thank you I will try that. I dont really know what else to do aside from give up. If only I had taken a bit more responsibility for my finances before I got into this pickle.

Sorry to hear of your problems.

Have you tried asking for a little more time? Two weeks is not really realistic to expect you to find somewhere.

Do you have any friends (cat friendly obviously!) who would be willing to put you up on a temporary basis?

Where I work we have want ads on the intranet and people advertise places to rent on there. Do you have something similar?

I am afraid it is just me. I dont know anyone where I live currently and I need to stay here due to my work. As far as I know we dont have any work systems in relation to advertising. My ex partner wont negotiate anything via his solicitor and the letter is quite clear that if I dont move it will be court proceedings. I earn too much to receive free legal help and as I have an IVA I dont have any savings.

Hi. Sorry to hear of your situation. After 15 years I would imagine that you have some beneficial interest in the flat and that you can't be evicted like this. I am no expert, so would suggest you get an appointment with a solicitor yourself, many do free appraisal appointments.

Of course the other thing to do, if it is still open, is to visit the CAB and ask their advice.

The property I live in was only bought 3 years ago prior to that we were renting. The solicitor letter stated that if I applied for beneficial interest I would lose as my ex partners mother gave the deposit and he paid a little more on the mortgage than me as he earned more.

You need to take advice from an independent solicitor. You will have some beneficial interest if you have been paying towards the mortgage. I take it only his name is on the deeds?

Is there anything in your IVA about trying to release any of your share of equity towards the end?

His solicitor will try to paint as bleak a picture as possible for you and, basically, bully you into giving up. You have an interest, despite what he says. Apart fromn the money you have paid into the mortgage you have invested yourself, too, over quite a lengthy time.

Thank you. I am quite concerned about paying for a solicitor as if I lose I will have less money left to move. Because we were in a relationship we had no written agreement between us about what would happen if relationship broke down. All the information so far indicates that as he owns the flat he can easily evict me or change the locks as I have no rights as there was never an agreement. Am not sure what the IVA states about equity.

You should be able to get a free half hour interview with a solicitor who will point you in the right direction, or see if you have a CAB and ask for an appointment as a matter of urgency.
