Rent less than I&E!

Our rent is less than we have been allowed on our I&E by £150 a month - do I have to inform IP or because this has been allocated in our montly allowance can we retain and off set it against some of the other essentials that our I&E has underestimated on eg electricity and council tax,petrol ?

You are the one that is signing your IVA proposal confirming that the figures are accurate, and it will therefore be you who will suffer if creditors find out that false figures have been put forward.

If the IP has done this deliberately, I suggest that you find a more reputable company to work with. Creditors are currently auditing proposals put forward by various firms, in an attempt to stamp out inappropriate practice such as this.

My IP suggested that up to £800 was allowable for rent once the sale of our house was completed. I am more than happy to declare the "balance" of rent and if necessary pay it to my creditos- just confused as another post a few weeks ago directed me to think that I would be allowed to retain whatever I did not spend in my I&E through good housekeeping/management/budgeting etc

Your situation is slightly different Lizzie, n that you are not paying rent at the moment but making a provision for future rent. When you are subject to a rental agreement, your IP will need a copy of this and if the figure you are paying is less than the provision you can expect to have to increase your payments by the difference.
