One more point.

A motability car isnt on finance, it is actally a lease hire.
Though i dont know if that would make a difference.

Probably not ... I have just had to acquire a lease car through a special route i.e through a website Andy posted which was especially for people with bad debt. The thing about income derived from benefits is that it is more solid and reliable than income derived through employment which can fluctuate. I have never undrestood why benefit income is not accepeted in such cases ... although benefits such as Child Tax Credit ARE considered as income!

Just out of curiousity, is the motability car on a certain length contract? If this is the case, that's where the finance check may come in.
I agree that as it's paid direct it's a guaranteed payment. However, it was my understanding that the person who is receipt of the DLA could chose to have a car or the benefit to pay for taxi's etc.

Going on my experience only, i wasnt checked. I was told that as long as i had at least 12 months left on my mobility award then i WOULD qualify to join the motability scheme. I simply had to have a form stamped in my local job centre plus office, giving the car company permission to release the car to me on or after a certain date.

I would be very interested though to hear what Motability say about it.

Ok, i have just phoned Motability and they informed me that they have lots of people who are bankrupt on the scheme
All it involes is a little extra paperwork but an application would most deffinately not be blocked because the person is or has been bankrupt, providing they are still in reciept of the mobility benefit.

Hi everyone. I have been away from the computer today and can't get over the number of people replying to my post...so thanks everyone for their advice.

We definately need or motability car as it is the only way for my husband to get around. He sees it as his legs and therefore his freedom as he has a lot of bad days walking.

I will be looking into debt management before we consider bankruptcy. I really want to repay my creditors and have even approached my bank for a consolidation loan. Unfortunately they turned us down. The ironic part is that a week later they increased the credit limit on my credit card!

I've got a motorbility car. Although there are no credit checks it does say in their contract that the car will be taken away if you are deemed insolvent.
I know from my days working in benefits that we were informed of bankruptcy whether the person was claiming benefits or not. I don't know if the same goes for IVA or if the people working there realise it has any significance.

This is one reason why I haven't yet applied for an IVA as I cannot afford to loose my car I live in the middle of nowhere.

The contract is for 3 years at a time. You then choose another car after the 3 years.

I was terrified that they would come and get the car by finding I'm in a debt management plan. I do like to worry about everything but I don't think you can rely on what one person has told you on the phone. Now these things are dealt with by call centres they don't always have the expertise.
Try ringing a car company that you don't want to deal with and give them a false name and your mobile number. They would surely find out the facts especially if you mention what it says in the contract.
Also ring Motorbility two or three times and if you get the same reply you can think of it as more reliable than some faceless person that would deny all knowledge when they're towing your car away.
