Well we made our final payment at the beginning of July, so rang our IVA people to check how far along the closure procedure we were.... only to find out they are still waiting for Nat West to make claims on the Credit card debts. I said that after 6 years it was outrageous that they hadn't made any claim at all. The girl on the end of the phone told me, it could still be another 3 months (already waited 1 month). Not impressed to say the least. Does anyone know how long it takes once all the claims are in?

It does vary from firm to firm, Mel has just done one in 6 days but others have to wait longer.
I would keep pestering them.
I think that anyone who hasn't made a claim by the time your last payment goes out should be omitted and the others get a bit more. They're quick enough to hound us when we miss a payment or two!!

Thanks... I agree. I think that the rules should be changed, so that once an IVA has been agreed, then all claims should be submitted by the 1st Anniversary of the IVA. That gives everyone a full year to submit their claims. After all, it's not as if interest or any additional fees need to be added, as there should be no change in the balance of accounts for the duration of the IVA.
Outrageous! I believe creditors get 28 days from notice of the last payment to put in a claim. So I'm guessing your IP hasn't started the closure process yet and even notified them! Unacceptable.
I don't mind if they delay in putting in the claims - I just pay my money every month.
If they've not done it though by the end then enough is enough. They've had 5/6 years in which to do it so they shouldn't get any if they can't be bothered.
As soon as that last payment is made then the closure process should start.

A couple of months ago they started to 'chase' us about our old bank account, which had an overdraft facility that was part of our IVA.
We explained to them that the loan, the credit card and the overdraft on the current account were all part of our IVA which TiX accepted on their behalf.
At some point some bright spark in Nat West decided to start to apply charges (again) to the current account, eventually taking it over the agreed overdraft limit into big money charges!
We have had dozens of letters and statements applying daily charges of 30.00. They chose to ignore us about the IVA. We have even had a house call from someone acting on Nat Wests behalf to 're-establish contact'.
It went quiet a bit after we sent them a copy of our Chairman's Report but they started back up shortly after.
Oh, and they claim we are still using the account because of all the recent activity. The recent activity has being them taking charges out and applying interest!
An absolute shower they are. I'm pleased to see the back of them!

I am with DFD and made my last payment beginning of April. I learned a couple of days ago after chasing for some time that only one creditor (Lloyds TSB) left to claim and that the final deadline for them is 16 August after which if no claim made they will be excluded. They have given an approximate time of only 2 weeks after that for the completion certificate to be issued which would be great. However, that comes to 5 months in all and I am afraid it would appear from other posts too that DFD are generally at the slower end when it comes to closure. (See post 'DFD. Yes DFD are quite slow, I made my last payment in May and all my creditors claims were in. Have been assured it will be closed by the end of Aug/ start of Sept as my IP is on holiday. You really do need to keep chasing them though, I dont think I would be where I am now if I didnt call once a week for an update.

if im off on holiday from work they dont leave everything till i come back.
dont care what your title is get things in order before you b***** off.
i know not every firm works the same way but its a poor show when you been through 5 years of hardship to then have to wait for somebody to come back of there hols

I'm afraid that if I'm on holiday then my work waits until I get back unless it is mega urgent.
Even IP's and caseworkers are allowed holidays.

im not saying they arnt allowed holidays but if they let the case workers do the donkey work and deal with things for 5 years then the least they can do is see what needs doing in antisipation and sign stuff before they go.

They cannot always anticipate what may happen while they are away and the case worker may not be able to deal with it.
Cut them a little slack - they are human the same as the rest of us.

im not having a go at ips at all.
what im saying is that they know whos iva's are ending before they go away so anything that needs sorting out before they go away should be looked at in advance.
i am required to have thing ready for reveiws and paydslip reveiws so the same goes fot the iva company.
getting to 60 months and then still not knowing where you stand is not on.
if i was in this position i would not be bothered if the ip is on there jollys or not but the machine still carrys on regaurdless.

I find it astonishing that a case can run for five full years with no dividends having been paid because claims have not been agreed. This does happen in a few isolated cases - mainly those involving trade creditors - but when we are talking about major banks it just does not make sense.
Thank goodness the IVA protocol now makes it clear that creditors are excluded if they have not submitted their claims within the first four months.
