Check your paperwork to see what it says about overtime - there should be something in there about it.

If you could manage to pay back 100p in the pound plus fees then that would be great.

Funny how we dont have the same view for people who complete early doing a F&F but dont pay back the full amount. Comments like the above not a little unfair?

I appreciate people may not feel Mitch is embracing the 'spirit of an IVA' but its their decision and i think its very unfair to make comments otherwise, especially when there is a constant double standard in regards to how much is or isnt payed back!!

Things like whats been posted on this post is precisely what i was referring to by being shot down in flames by the 'in' crowd!!!!

Were quick to condem posters but eager to stand and applaud IP companies when they do what their paid to do......how odd!!!

In my opinion there is no 'in' crowd. What would you like us to do? Tell Mitch to keep additional income from his IP and then in a years time when his IP looks at payslips / P60 etc who do you think will get it in the neck? Not us.

And your point about f&f's being accepted is a bit harsh - there are many reasons why people cannot fulfill the full 5 year agreement. I am a prime example of this. Creditors all voted to accept a slightly lower return which they have received 4 years earlier than anticipated.

We are here to advise on the process of the IVA and have no option but to try to convince posters of the correct thing to do.

Just as we do when people who have finished their IVA's ask us if they can claim back PPI. To me writing off debt is a fantastic way to start again, to then turn round and claim money from these creditors is not ok in my view.

I was certainly not trying to shoot anyone down, but to blatently admit that you have the intention to pay back as little as possible is as you say not 'in the spirt of the IVA'. I realise that everyone's circumstances are different, and the original poster has as much right to have debt written off, if at the end of the IVA, there is still debt outstanding, just like the rest of us. But it would be nice to know that he has the intention to pay as much back as possible, just like everyone else.

But surely KAYKAY if we all 'have the intention to pay back as much as possible' we would all be requesting our IP's to maybe extend our own IVA's to ensure we it all more back?!?!?

what you say cant be true, surely the attraction of the IVA is that some of the debt is written off!

I wasnt suggesting anyone hide anything from anyone Kazza, what i was saying was it was clear that the OP had made a decision and was sticking to it, they asked for advise, got it but decided to continue on as they had planned. I just feel sometimes things are a double standard here.

When I took out my IVA (I am speaking for me only when I say this), if they had said to me that you continue to pay in this manner until your debt is cleared... belive me I would have agreed, just to have some control back in my life.

I don't make the rules governing IVA's, nor do I set the timescale or structure. I know, and truly appreciate how lucky I was to be given this second chance and to have had some debt written off. I guess when I made the "have cake and eat it" statement, I was questioning the sincerity towards the IVA of the original poster, and apologise if this has offended anyone.

artemischild, being fairly new to the forum and certainly not considering myself to be part of the "in crowd" whoever they may be, or any other crowd come to that, I have to say that I agree that we should pay back as much as we possibly can towards our debts. We borrowed the money, indiscriminately perhaps and now have to face the consequences. We are given a fighting chance to turn our lives around and I for one am so grateful for this and am more than appreciative of the fact that I do not have to pay back the whole of the debt. To have the attitude of "I will pay as little as I possibly can" does not embrace the spirit of the IVA and whereas I take on board your comments, I personally am not out to deceive anyone whilst in my IVA and do not think that others should do so either!

Isn't the IVA based on what we can afford? reviews conducted annualy to take into account increase in expenditure and salary? so if circumstances change creditors look at what is best for them and either decline or accept F&fs? I have made 4 payments so far every month I have uplifted extra as this is what i agreed to do when i signed up (legally)

No one is debating what the IVA is based on (legally or not)

I was making a point that’s all, take for example posts where a poster is having a common problem with a company, very few comment on said posts and say 'this is terrible, something should be done about it' etc or even 'as a group we should, on these forum boards, ensure people coming on the site know which companies are problematic' until they sort it out. Instead the majority stay quite when problems arise yet all jump on each other to say 'ohhhh well done for doing your job' ‘how wonderful you are’…..when did people start forgetting many of us are paying for a service?

There seems to be this fear that IP’s and firms cannot be called into question publically and I think its utterly wrong!

The only problem with slating some companies is that they can take offence as happened earlier this year and it has caused huge problems for certain posters as somehow their personal details were obtained and letters sent to them.

Any of us on the Forum are there to be shot at and if your firm lets you down you have to deal with it. There is also the fact that those of us from the industry who do post often have to defend and justify the entire profession. The VAT and PPI issues are an example where something that was not the fault of the profession caused so many problems and only a couple of us were on the Forum trying to explain.

This is going off track again so i'm off![V] i just pointed out the poster was potentially going to get in trouble not declaring overtime i'm no expert just have experience as my pay fluctuates every month

The point raised re. F&F's .... these are AGREED by the creditors. Stuffing undeclared money aside is definitely not AGRRED ... indeed, it is specifically against the terms of the AGREEMENT signed in the first place.

All that apart, it is entirely up to the OP what he does. We are just making sure he is aware of the possible repercussions. How would he feel about the forum if we all said "good on you, keep it away from the creditors. We support you" .... and in 4 years time his IP fails the IVA and he is back in a deepr hole than before ???? I can guess .... "Well, they said on the forum I was doing the right thing .... it's THEIR fault !"

Many companies HAVE been lambasted on the forum. It has many times been said, by posters, experts and IP's themselves, that the recent situation at GT is intolerable and indefensible, as well as critisisms against other firms, where they have gone wrong. By advising posters to email Karol serves two purposes: 1) It alerts GT and they generally do go on to sort the problem out on an individual basis. 2) GT can see if a pattern develops and deal with it ( as they have done in the past.

At the end of the day debtors, creditors and IP's have a legally binding relationship and, if this goes wrong, it is only courteous to try to resolve this privately, before airing the dirty laundry in public.

If you have a bad experience with a firm by all means come on here and state that, so people can judge the firm. Also come back and say whether or not it has been resolved. But we don't need running arguements online.

funny how the bankers got there cake and ate it,and then got more cake,then we paid for their cake so do i feel bad about not being able to pay me bank back,i wont loose sleep over it,but if i won the lotto id pay them all tomorrow
